I would wager there is no law that specifically covers the pics we can assume he was attempting to take, so the cops are going to throw whatever they can at the guy, and there is an eavesdropping law so they went with that. I'm not sure it will stick, but I can see them trying to find whatever they can to charge the guy. I'm not sure too many people have a problem with an expectation of privacy in a bathroom stall.

Usually there's no specific law about it. Sometimes it counts as disorderly conduct. A woman from Texas(?) had a brief moment of late night talk show fame in the 1990s after being arrested for using the men's room.

A couple of years ago a couple discovered the mirror in their bedroom was two way and had a camcorder setting behind it. Seems their landlord was a bit of a voyeur.

Long story short. At the time there was no law against filming, well, pretty much anything. However there was/is plenty of laws against recording private conversations. The camcorder was also recording sound so they busted him for that. Had he turned off the sound recording on the camcorder they could not have, at that time, charged him with anything as it was his property.

I thought pretty much everywhere had made laws regarding filming or taking pictures where there was a 'perception of privacy' in recent years. Surprised they are having to fall back on eavesdropping in this day and age.

When I was in college, one of the fraternities did this, but with a tape recorder. The funniest thing they said they heard was two girls talking about not being able to get laid. The one quote I will never forget: "There's 100 feet of dick here and I can't get 6 inches". Classic.
