Even if he admits that he robbed more, he probably won't get prosecuted for them.


Even if theoretically he couldn't get prosecuted for them, it was still a bad move to fess up to them before being sentenced. Right now he faces a maximum of 20 years for each of his 4 counts, or 80 years altogether, which is a life sentence. If he didn't fess up about the other 23, maybe he wouldn't have gotten the max. Now he's almost certain to get it. It looks like his life is over now.

I had to go to traffic court early in the morning a few years ago.

The first guy argued about all the previous speeding and traffic violations he had gotten away with, and was stuck with some minor ticket. Judge not amused.

The second guy, a teenage punk, argues about a altercation with the cop, including "his reving the engine was a engine malfunction" and "his muffer was broken" blah blah, kid was an ass. Judge not amused and threatened contempt of court.

I am sitting there thinking that I feel sorry for the next guy after these two asswipes have ticked off the judge. Guess who was next.

Maybe it's a self esteem issue. He doesn't feel so slick now that he was caught committing these four robberies so to help boast his self image he felt the need to brag about his other robberies that they were unaware of. That way he (maybe in his eyes) still seems smarter than the legal system that caught him. Who knows?

Actually, if you cop to other offenses, the sentence includes those too, and you can never be tried for them. Of course, that is something to negotiate for, not to do on your own at the last minute...

I'm not sure. He might be better off to volunteer his other robberies now rather than get prosecuted later for them, depending on how likely it is for the cops to figure out that he did others.

Chances are, once you get nailed for one bank, the investigators for the other robberies are gonna see if you might have done theirs.

He would have been really farked then. As each one came to light, he would have gotten another trial with, probably, a worse sentence. At least this way, he'll get the same sentence for each crime, and not have to worry about getting away with those crimes as he approaches parole.

Of course, chances are he will never live to see parole. If he does, his admitting this will probably help him.

In the UK if you give info on other crimes you have committed it helps clear up the cases. So we say the confessions are taken 'into consideration'.
It can mean less time locked up.

Kinda like a plea bargain.

Use of confessions related to plea bargains is limited. I don't know if they can use these confessions to prosecute him for the other crimes.

But under US federal law the judge can punish the defendant for other crimes he may have committed, even if he has never been charged and even if he has been acquitted of those other crimes. There is no right to a trial by jury as long as the judge says it is a "sentencing factor" rather than a "crime". And double jeopardy doesn't apply to "sentencing factors", so the defendant can later be tried for those 23 robberies even if the judge has already considered them in the present case.


We were headed for a system where the jury could convict of jaywalking and the judge could sentence the defendant to life in prison because he was suspected of murder. The Supreme Court slowed down the trend in the Apprendi case a few years back. But the right to trial by jury is still badly eroded.

Well one thing to think about is the world record is only in the 20's for number of banks robbed by one person. So I am guessing that he might be trying to go down in history as having the most.
