While the article is trying to paint this as a women's rights issue, and I'm sure it does suck from that perspective (pun not intentional), my concern is the rampant abuse of the "sex criminal" label.

I mean, holy crap, we're spending how much money to "protect our children" from people who wouldn't molest them for less than $50 a pop (again, pun not intended)?

2010-01-20 05:32:44 PM
Doesn't the constitution protect against cruel and unusual punishment? I can see a lawsuit in NOLA's future. Religious nut case Republicans trying to make sex a crime as usual.

2010-01-20 05:36:29 PM
wait, is it for "unatural copulation" or against it?

If my penis fits, it's natural.

If it's a hole and it's got hair around it, it's bound to be farked!

I'm fairly certain Lawrence v. Texas settled the issue of whether the government could call "oral or anal sex" unnatural copulation and charge people under that. It seems a real endrun around the current laws in the state.

2010-01-20 05:44:15 PM
Doesn't that kinda kill the cash cow of Mardi Gras?

2010-01-20 05:44:30 PM
Unnatural copulation? Sex between religious folks not for the purpose of producing children?

FTFA: The law, which dates back to 1805, makes it a crime against nature to engage in "unnatural copulation"-a term New Orleans cops and the district attorney's office have interpreted to mean anal or oral sex.

Uhh... and here I was thinking they were going around telling people not to fark fences, stray animals, or random inanimate objects.

How do you define unnatural? Anyone got a legit answer to that that doesn't also imply that humans should be naked? I thought not

2010-01-20 05:47:12 PM
So a gay couple could also be listed as sex offenders for doing their thing.

2010-01-20 05:48:06 PM
I'm pretty much inured to stories from the American South that suggest it operates sometime in the 1850s, but in New Orleans? Seriously?

2010-01-20 05:48:22 PM
Yep, labeling someone a sex offender (when they are not really one) will really help them get their life back on track and find normal employment and a place to live. I hope someone sues the crap out of NOLA for doing this.

There also needs to be a federal mandate to purge blue laws.

I had the same thoughts. The problem is that until the laws are challenged in court they remain on the books, even though they are technically unconstitutional.

The site has been unnaturally copulated after only 246 hits. Sad, really.

might as well cancel my trip now

Oh wait, there it is. Wow, they're criminalizing anal and oral? Wow. Welcome to the 1950s.

Latinwolf: So a gay couple could also be listed as sex offenders for doing their thing.

And any couple (or threesome, or whatever) that has oral sex. Under the law as stated in the article, it is illegal to give a BJ.

/cue outrage in 3...

Came here to say this. Did nobody bother to tell the Cajun Cops about this little tidbit?

Enforcing laws that cannot possibly withstand legal challenge is just a massive waste of money. Is this Jindal's doing, or am I silly to think that he would get involved in local law enforcement?

Many laws remain on the books even when found to be unconstitutional. Just because the supreme court rules against the law, doesn't mean the law has been repealed. That would take an act of the legislature. A cop can enforce an unconstitutional law, and while the charge won't stick, he can still take you to jail and make you go through the process.

2010-01-20 05:55:21 PM
Most cops are wimps. They'd rather bust someone for traffic/prostitution/minor drug possession than do something that really benefits the public good, like take down a meth lab, cause, that's like DANGEROUS, and stuff, and danger is most certainly not why they get paid well with lots of benefits (on AND off paper), possibility of early retirement with a great pension and impunity from the consequences of beingt a dick.

GOOD. No one needs skanky ho's while your trying to enjoy NOLA.

I would think that unnatural would be animals, underaged people and any object other than a consenting adult. But I guess that a sex with a nonconsenting adult also is natural but I doubt anyone would do that in court.

2010-01-20 05:56:20 PM
Considering some of the people I've seen attend Mardi Gras, I have to say that I wouldn't be entirely put out if the next hurricane that hit New Orleans happened that week.

Of course, that's just my evil side talking. My good side is preventing him from activating the hurricane machine.

I got the link to work once...

Page 1 says that they're labeling prostitutes as Sex Offenders based on the assumption that they perform "unnatural" sex like oral or anal. And they go on about all the trouble that means. An interesting tidbit, that also means they get a "special" stamp on their driver's license.

So I guess there's now a stamp on your license certifying you do anal? Ma'am, I'm need to see some ID here.

There's also the question of *why* the law was invalidated. If it was rendered unenforceable due to privacy (fourth amendment), I can see how the cops could still cite/arrest people for the prohibited action if it occurs in public where there is no expectation of privacy.

Don't have sex (natural or unnatural) in public and you'll be fine. It's not like there are secret police in every bedroom.

2010-01-20 05:59:40 PM
thomps: wait, is it for "unatural copulation" or against it?

Further more, I've noticed that many of the sex-offenders in New Orleans aren't charged with statutory rape or indecent exposure or anything like that, it's usually "Crimes Against Nature". That sounds very ambiguous, and since I don't feel like looking it up, what the hell does that mean?

2010-01-20 05:59:42 PM
That's sad and wrong and more abuse by city officials. I love my city but the people who run it make me angry.

Isn't a story about NOLA cops enforcing a law related to morals required to use the Ironic tag under Fark Rules 42(B)(iii)?

Sounds like things are all fixed up there in the Chocolate City. Heck of a job, Brownie.

And since this is a New Orleans thread- any Nola farkers with good media contacts or a lot of followers in social media- please email me. The St. Bernard Project is the only New Orleans charity in the Chase Giving contest right now, and I'm trying to get as much support for them as I can.
