The city Medical Examiner's Office ruled Murillo's death a homicide. But the Prosecutor's Office said there was no probable cause to pursue charges against the men who, according to the autopsy report, held Murillo down on the ground by applying their weight to his back while he lay on his stomach.

The autopsy showed he was not breathing and was foaming at the mouth. He was taken to Straub Clinic & Hospital, where he was pronounced dead shortly afterward. He died of mechanical asphyxiation, which was confirmed by autopsy results that showed pinpoint bleeding in his chest, shoulder and eyes.

Police said the store manager ran after Murillo for failing to pay for two 12-packs of beer, caught up with him on the second floor of the Hyatt and demanded a receipt. Murillo then allegedly assaulted the store manager, who called for help, and a 20-year-old visitor helped to subdue him.

The autopsy shows Murillo also suffered bruises and abrasions around his eyes, jaw, shoulder, arm, body and abdomen.

There may be more to this than what is presented. We don't know if the man (suspect) was trying to fight off these people and they (manager and tourist) tried to restrain him by (I'm assuming here) sitting on him, or if the two people where actually trying to kill this suspect (which I doubt).

Not that i disagree, but it was his fault that he stole and ran, and it was their subduing him that apparently caused his death... one doesn't make the other right, but it is at least partially his fault... and there is no way his wife ought to be able to sue

I think the guy has a right to sit on him til the cops get there.

They didn't execute him. He died during their attempt to restrain him. Big difference. A big hawaiian sitting on you can do that.

Guy should have just dropped the stolen beers and run.

Sounds like she's gonna win. This is one of the reasons why so many places have strict policies for their employees not to do anything physical about shoplifters. You get the tough guy wanna be cops that play too rough and someone dies.

They are lucky they aren't being charged, people have gotten hit with manslaughter charges over that.

Holding someone immobile without hurting them is not as easy as it sounds. Most people will get out of any given armlock given enough time. Particularly people who have been drinking, who don't feel pain the same way as sober people.

Which is why, unless you are really expert, you keep them moving while locking up their arms so they can't regain some balance and leverage, or you just break their elbow.

So, you don't apply that kind of lock (kneeling on their back, probably learned from watching COPS) without knowing what you're doing. Or, as a Judo instructor once told me, you don't choke someone out unless you know how to bring them back.

Won't somebody please think of the Beer??? I haven't found any details at all on the Beer's condition after this incident. Were any of them broken open? Were they shaken up? Did they get back to a cooler in time? It's reporting like this that has shaken my faith in the media.

Why do so many people have sympathy for a thief? He wasn't stealing food for his family. Then he fights the manager? Fark him and anyone else messing up society pulling crap like this-and his wife for filing a lawsuit.

Crimes like this are stupid. We need a law that says if you are comitting a crime, you have no right to sue for anything that happens. The worst thing that will happen is we will have a few less criminals.

Its great. This guy died trying to steal beer, and his wife is going to have to pay a shiatload of legal bills after her case will be dismissed.

A just punishment would be to force him to drink all 24 beers within a matter of 20 minutes and then watch him die from alcohol poisoning. If that doesn't work add in 10 shots of Bacardi 151. That should finish the trick.

If these guys actually did use excessive violence, cruelty or gross negligence causing the theif's death, then are also guilty of a moral and legal offense, not yet knowing whether that's the case or not I have to reserve judgement and keep my prejudice in check.

You don't get justice by meeting an injustice with an even greater injustice.

I'm with RickRR. If you're in the process of a criminal act, no civil recourse against the property owner or citizen who in good faith intervenes to stop the act. There would have to be some wording to prevent people from using over-kill but in situations like this where the shop owner is in good faith trying to restrain a shop lifter and harms him...screw the shop lifter. I don't mean you should get to shoot a kid over a candy bar, but if you yank his shoulder out of socket catching him...fark him. With the additional info that Megain posted it sounds like they gave him a fairly severe beating then held him down (or held him down while they wailed on him) Thats probably a bit much, but not if he was still fighting them. Being a theif should be a dangerous thing.
