The point was that the prosecutors used statements from the contractors that were supposedly coerced under threat of losing their jobs. I'm sure this is going to make us look great in the eyes of Iraqis.

Yep, because the prosecutors threatened them with the loss of their jobs if they didn't make those statements, actions that they were advised against doing so by more senior prosecutors.

Still seems the Judge was the one who dismissed the case, headline makes it sound like the Justice Department dropped charges or something.

Judge dismisses charges against Blackwater defendants (new window)

WASHINGTON - In a rebuke to government prosecutors, a federal judge on Thursday dismissed criminal charges against five Blackwater security guards accused of fatally shooting 14 people in Baghdad in September 2007.

Judge Ricardo Urbina said government prosecutors violated the defendants rights by using incriminating statements they had made under immunity during a State Department probe to build their case.

"The government used the defendants' compelled statements to guide its charging decisions, to formulate its theory of the case, to develop investigatory leads, and ultimately to obtain the indictment in the case," Urbina ruled.

"In short, the government had utterly failed to prove that it made no impermissible use of the defendants' statement or that such use was harmless beyond a reasonable doubt."

The guards had been charged with killing 14 Iraqi civilians and wounding 18 others using gunfire and grenades at a busy Baghdad intersection.

They faced firearms and manslaughter charges.

Sounds like a lot of eff ups between the State and Justice departments, but "Christmas present while you were diverted" is very misleading. Makes is sound like the Justice department acted (a la Friday press releases) over the holidays, willingly letting them go.

That's not what happened. But I do agree with the sentiment that they were given a "gift".

To be fair to their lawyers, they wouldn't have been able to do that if the prosecutors hadn't based their entire case on statements they obtained by offering immunity for the statements.

I mean, this was a softball.


The problem arises when, rather than taking a hard look at prosecutors' and investigators' practices and competence, we respond as a society by making it more difficult to 'get away' with wrongdoing.

IMO, they botched the case on purpose.

The US is going to have a hell of a time hiring mercenaries if we just turn around and prosecute them. It's a whole clusterf*ck of wrongs trying to force a right.
