It's stories like this that have ensured that if I ever buy a home, it will not be involved in an HOA of any sort. Fark the HOA assbandits - they're scum and deserve a lot of discomfort in their lives.

As I grew up near Largo, Florida and dealt with mean, old people in my neighborhood, I'm interested on how this went.

Lets establish a few things:

1. They bought the home knowing it was a retirement community. It's adult living, adults only. They knew that.
2. The case was ongoing for "several years," (FTFA)... so no question, this was before the recession and the "housing prices" argument is a BS argument after the fact.

No sympathy from me. They bought something and now are upset with their purchase. Unless they can show how they were tricked buying into an adult community, this article just states they are morons.

I am wondering if the Home Owner's Association rule is not a civil rights violation that discriminates against the child. This is not like some rule prohibiting having a dog or cat. This is a human child and a blood relative.

If they manage to evict the family and the family cannot get a buyer for their home, cruel justice would have an army of drug addicts raid the home owners complex and cause mayhem. Make life miserable there.

My wife and I fell in love with a house not long ago but decided not to buy after reading the HOA covenant. I'm not going to get out in my yard with a ruler to make sure that the grass is 1/2" high or ask for permission to plant a tree in my yard, or have to put up a specific kind of fence. Oh and this particular covenant mandated that all house parties involving more than 2 guest cars must notify the HOA and should limit outdoor activity to less than 2hrs after sunset. BULLFARKINSHIAT. And you know there's some old retired busy body who will make sure that everyone knows when you break a rule.

The people who bought the place are part of the problem.. Then were just fine with the rules until they effected them

The state should be ironic about this and charge the HOA the foster parent fees. namely the president and seize his home if the HOA does not pay up right away.

Legally no, like how you can't have cook meth on your property, but how many of the restrictions violate your constitutional rights?

Any HOA would probably be pissing their pants over what my wife and I have done to our lawn. The front has been landscaped how we saw fit and given over to some young fruit trees, flowers, and herbs.

Hehe.. When I was in HS my girlfriend and I went to stay with her grandparents in one of these communities outside of Tucson. We played tennis and drove a golf cart all weekend. It was a great time and the old folks looked like they wanted to kill us. They wouldnt let us play golf though. Apparently they draw the line somewhere.

In this case they MIGHT be obligated. 55+ communities are setup in a specific way with laws that allow them to exist. They are not regular associations. I would bet they would lose their status to legally discriminate in the future.

Sucky situation, but it's a retirement community. i.e. it's for retirees. People that live there don't want to see/listen/deal with kids on a regular basis. And they have a contracted legal right to it.

They have allowed them, and let them sell (for 5 years if i recall correctly)

This situation has been ongoing, they have been tolerant, but it has become apparent that the grandparents are not going to resolve the situation.

All you people yelling how you will never buy a home in a development with a HOA; Good For You.

These people did. They had ample time to sell before the housing crash. It's a sad situation but if they really want to keep the family together, they should move out, or sell it for $100,000; or sell it for $75,000.

Frankly, the HOA here could have a heart and let them stay for a while longer, it's been 6 years already. But they don't have to. It's absolutely their right to be assholes and everybody moving in knows the rules. Particularly the rule about children in a retirement community.

The only rules in my HOA are common sense ones like don't park in someone elses space, don't have parties so loud as to infringe on your neighbors, etc. If they ever started making asshole rules, they would be voted out in a heartbeat.

I'm with the rest of you who would never move to a place with overbearing and restrictive covenants.

I once lived with a HOA. For $225 a month they mowed the lawns and trimmed some hedges. No pool, no nothing else. Most people didn't bother to pay theirs. I was so glad to get out of that place.
