10? years ago I read about boaters suing the NWS after getting caught in a storm at sea. Maybe it was their families who sued after they drowned. The suit got a lot farther than I expected. I don't remember if they won. Does anybody remember this case?

In the unlikely event that the private weather broadcasting service can be shown to have known about the turbulence and withheld the information for some nefarious purpose, I would hope they could be held liable. Not the FAA, unless there is some law allowing the suit to take place.

There is no way to prove that the WSI failed to do it's job correctly in forecasting such a small-scale event as turbulence. This suit is as frivolous as the douchenozzle who sued the dry cleaners for $50M.

FTFA: when the aircraft hit "previously unreported severe turbulence" before landing,

Doesn't seem to be what's at issue. Hell, I'd think *ANY* flight would have a chance for turbulence.

Alaska's FAs are almost all on the old and unattractive side. Want hotties? The best I have seen were on Singapore and Aeroflot. SAD and Air France were strong runners up.

Sounds like she might have damaged her brain pretty severely. That explains the lawsuit.

I'm sorry, I was under the impression that predicting the weather was a pretty unreliable thing in the first place. I mean, yeah, you CAN predict it with some degree of accuracy, but how difficult is it to determine where turbulence might be at cruising altitude for an aircraft? I'm no meteorologist, so I honestly don't know, but it seems to me that something like that MIGHT just be hard to predict.

Speaking about greedy lawyers can anyone recommend one for me. When I graduated from high school they gave me a diploma. That should have meant I had an education. Sounds like a better lawsuit than blaming the weather man because the wind blew.

Blaming WSI for unforecast turbulence? That's the funniest thing I've heard all day. There is always turbulence going into Ontario. It'd be like me suing NDDOT because they didn't tell me about the bumps on the gravel road.

Apparently she didn't listen to her own safety briefing.

Sucks that she got hurt, but she should sue herself for being such a dim bulb in the first place. What a farkhole.

well if this sets a precedent against the NWS, i'm totally claiming damages for planned trips to the beach that got rained or fogged out, and my dry cleaning bill for when i got caught in that spring shower, and that time i got sunburned when the local weatherman clearly promised me partly cloudy and breezy.

No, generally both sides pay their own costs, unless the attorney was able to get attorneys' fees and court costs included in the judgment. Even then, it's not a given. Most of the time in US courts, the loser does NOT pay, which is why we see dingdong lawsuits like this.

Even though I'm halfway through law school, I'm a big fan of tort reform; but given the power and $$$ that tort lawyers have, I'm sure it will never happen.
