I'll never understand why we don't have 'degrees' of sex offenses. First of all, 15 and 17 should be a misdemeanor at worst ... Second ... Even 25 and 15 (consensual) is nothing even close to genuine kid farking and it's deplorable that we toss them all into the same registry.

while i feel for the guy because he is stuck being unfairly labeled as a sex offender, my sympathy dropped off significantly because he violated his parole.

he knew the rules. even if the junk about being too close to his girlfriend was bogus, lifting the video games was pretty stupid. according to TFA, if he'd completed his probation successfully, the school-zone restriction wouldn't be in place and his current predicament could have been avoided completely.

I love how the ex-girlfriend's mother, who started this whole thing because she's a nasty biatch who didn't want her daughter dating the kid, is now asking for his record to be expunged and that he be removed from the registry. Like that somehow makes it ok that, since she was pissed that her 15-year-old daughter was having sex, she ruined this kid's life.

What would the registries do if it were only for violent offenders? Let's say someone brutally raped & beat a girl, was released from jail after 10 years, & goes on the registry. If he wants to rape another girl, what exactly is stopping him from driving 3 hours to the next state and doing it there?

In that scenario, what effectiveness is the registry supposed to have? The whole thing was put in place as a knee-jerk reaction to the rape & murder of Megan Kanka here in NJ. 3 sex offenders lived across the street from her & one of them killed her while his housemates were away. So naturally, the only way to protect the children was to let everyone know at any given time where the sex offenders in their neighborhood was.

Stupid law then, even more stupid now. There's a sex offender living a few blocks away. He got caught masturbating in his car while parked behind an adult book store. So now he's branded for 10 years because he couldn't wait until he got home.

Well, at least she REALIZES she farked up and now wants to fix it. Too bad she didn't understand what she was doing at the time.

However, I think it's GOOD news that this case is going to court. The only way this sort of overapplying the booga-booga is going to be solved or even looked at with some sort of rational eye is if an actual case makes it through the courts.

I'm just surprised the two year age difference was enough to trigger the statutory rape charge to begin with, mom in favor OR not. Don't most places have a "...or within X years of each other" exemption for this sort of thing?

I don't agree with what she did, but at least she's trying to make it right. It would be a lot worse to me if she stuck to her guns and wouldn't admit she made a mistake.

I'm realizing the irony of going to a newspaper about this. Now that it's made Fark, anyone who searches for him online will likely find this article, so even if it's expunged future employers will still be able to find out he was a sex offender.

Not that most would care, but it could be an unfortunate unintended consequence.

Yeah, but statutory rape is pretty much only filed when a parent complains - if there's truly unconsensual sex going on such that one of the actual participants complains, it's a regular ol' rape charge.

And for various social reasons in the US, it's not too surprising that it's the parents of the girl who files. Plus, she was the younger one, so if there's "ZOMG my baby is being taken advantage of!!!" it'd be her parents.

That said, haven't there been articles linked here on Fark where girls were charged with child porn charges for posting pics of their own underaged nekkid selves on the Internet?

Oh, it's absolutely better that she's trying now... but if she hadn't gone batshiat in the first place, over what appears to be a kid with a pretty decent head on his shoulders, then this situation wouldn't exist.

It's one thing to not want your daughter getting boned at 15 - it's another thing to try to stop her by going after the guy and taking it so far that he ends up on the sex offender registry.

The sex offender registry is meaningless when people who are of no threat are placed on the list.

States across the country are having similar problems with zoning laws and sex offenders, both legitimate and illegitimate (meaning like the poor guy in TFA). Some city in Florida is experiencing a boom in homeless sex offenders because of strict zoning laws.

no doing X within Y feet of schools or where children would be likely to be.

logically, that is almost ok.
schools, playgrounds, amusement parks.

NO ONE wants X around kids.

the problem starts when Y feet is large enough and the number of places which kids congregate bascially creates a law where X is not allowed anywhere within the city limits. but, the law doesnt outright BAN X in the city ... just defacto

this crap happens in chicago all the time
you cant have a new bar license within X feet of a school or church. so people cant sell their bar because the new owners are unable to get a new license ....

sigh

And this is why - unless someone is charged and convicted of having sex with an infant based on pictures taken during the assault - any and all notion of people being "sex offenders" (let alone the 50% of the time false accusations that caused them to be designated as such) must be dismissed as mere hysteria straight out of "The Crucible."

/did you know that there are dozens of laws on the books in dozens of states that, when broken, even though the offenses contain no sexual element whatsoever ALSO require the guilty party to be placed on the "sex offender" registry???

Half my freakin' high school would be on the list. In the 80's when I was in HS there were at least 10 college dudes who'd come home on the weekend, go to the football game with their HS girlfriends, and then sit there in the church pew holding hands in front of god and the whole damn town and no one gave a shiat. Now they are sex offenders. Times change I suppose.
