Because they are well-versed with the brands that are out there, and carefully study the box before making a purchase, there is little chance that the nephews' line will be confused with Larry Flynt's films, he said in his opening statement.

Larry Flynt's attorney, on the other hand, said that a survey by his expert found that consumers presented with images of the nephews' films -- with the Flynt name displayed across the top in silver block letters -- overwhelmingly associated the product with Larry Flynt. The nephews' effort to take advantage of their uncle's fame was clear in one of their promotional fliers, which advertised, "You know the name, you know the game," attorney Mark Hoffman argued.

In the end, this is a pretty straightforward case of whether or not one company's marketing is misleading consumers to believe it's made by a different, more popular company. The porn part isn't even relevant.

He's got a point.

The porn being made is being constantly driven downmarket. Private used to make really slick, sophisticated looking porn, but more and more, they're just making a form of upmarket gonzo.

And all the spitting, deep throating to the point of wretching and all that... cut it out. It's horrible.
