So, unless it was scripted or set-up, then I do not believe it falls under the law. IMO (IANAL), the show would be in violation of the law if the scene was rigged (scripted) or if the killed the rat and fed it to the contestants.

An underfed person living in the wild, even on a reality show, should be allowed to hunt for food.

The law they broke was related to killing an animal for a performance, so I presume rats can be killed in an Australian kitchen as long as it's not filmed for broadcast on a light entertainment show without special permission.

Is it ok if they just kill it? I have had rat/ mice traps when I lived in Hawaii and we have some at out hunting cabin. I want to make sure thats its only "cruel" if it is also eaten.

Clearly there is a law in the Australian books about killing animals for a performance. I'd imagine most western nations have similar laws (probably more intended to stop bull fights, dog fights etc). The Australian RSPCA has taken the law to its literal limit in this case, it will most likely get thrown out of court as soon as it gets there.

The RSPCA is the Australian version of PETA except they have some law enforcement powers. They are usually doing a good job, except occasionally they fark up like this. Harden the fark up RSPCA!

The team has elected to try for a kill at pub, using the tricky and seldom used "loo lasso" which will catch Nigel round the neck whilst he's in bog. The difficulty here is that Nigel has no neck and a chest length beard, but he will be four sheets to the wind. The plan is to grill him for about 6 hours in a slow oven with a nice mustard and citrus glaze.

Suffering defined as 'must not be subject to pain in any way, nor any mental torment'.

Further, the killing of a living being by laymen may only be done as an absolute last resort, to prevent actual starvation.
At any other time, it must come from the supermarket, neatly wrapped in plastic. Once a month, you are allowed a sea kitten wrapped in sterilized newspaper.
