How many slobbering drunk guys did the paramedics encounter that night? I would guess a lot.... the guy didn't give consent to be taken to the hospital, so they assumed he was another fall down drunk. Madison is known for professional drinking and roving bands of dangerous fools.

I've done some ridealongs with Madison's P.D. and the UW's P.D. I was amazed at their patience and tolerance for the drunkards, idiots and drama queens they had to deal with all night. Unless they actually find the guys who beat him up, he needs to just chalk this up to one of those unforgettable life lessons.

And calling it a hate crime? Madison's criminals don't discriminate... everyone's money is green.

No one takes personal responsibility anymore. I would like to know what the argument with his female friend was about. That probably triggered the guys on the porch to attack him...I would say it's his own drunken fault, not some 'hate' crime.

All of that said, I don't know if this particular case is a hate crime; that would be up to any future prosecutors to prove in court.

Outside of her campus-area apartment, the friend made a drunken comment about Miller's sexual orientation. Four unknown college-age men standing on the porch took notice, and the next thing Miller knew, he was being knocked over a railing and onto the ground, unconscious.

If it went down as reported, that's a hate crime.

I know that getting sloshed in Madison will most certainly set me up for a robbing and beating. That's a lot of drunks in one small place. The criminals must think of Halloween as their ultimate pay day.

I just think it's stupid that this guy is criticizing the cops/firefighters for not helping him. Should they have called him ahead of time to tell him "Hey, when you're in Madison, don't stumble around drunk in the alleys. K thanks bye."?

What did he do that was stupid? His friend made a comment about him being gay, and he got jumped. Sounds like there's some story missing. But according to TFA:

"Outside of her campus-area apartment, the friend made a drunken comment about Miller's sexual orientation. Four unknown college-age men standing on the porch took notice, and the next thing Miller knew, he was being knocked over a railing and onto the ground, unconscious."

There's no statement of him doing anything inappropriate or stupid.

Personally, I think "hate" crime is a stupid categorization that just causes strife, since it gives preferential treatment to the same minorities that people already may not like. In this instance, who cares if the guy was gay? The muggers didn't care, they were just looting a stupid drunk.

Something doesn't make sense here. I don't know what the law is in Wisconsin, but here in Maryland, intoxicated inviduals are not allowed to refuse transport by EMS, as their inebriation precludes them from signing the refusal of treatment legal document. You may be going to the hospital with the cops instead of the EMTs, but one way or another, you are going to the hospital.

Thank you, glad someone else pointed this out as well.

Advice if you decide to partake in St. Pats in Butte: Go home between 9-10PM. Just about anything that happens after that point isn't something most sane people would want to be a part of.

That's an issue of fact for the jury to decide. Admittedly a prosecutor would have to show a specific intention to attack because he was gay, and there isn't enough in this article to know if that was the case.

Just cause they heard the girl comment that the guy was gay doesn't make it a hate crime.

They might have been hanging around looking for an easy target to rob. Then they hear how this guy is gay and think "Hey, if he's gay he's probably a sissy, we can easily beat him up and steal his stuff".

Hey, sport, don't believe every thing you read in the local yokel papers that was farking stage managed by a well known local plaintiff's personal injury lawyer.
