Depending on the state, mugshots are considered public records. It's highly unlikely that he can sue.

Sober for eight weeks, and he's making a cash grab. I doubt he'll be able to collect royalties, since mug shots are considered public property. He might be able to get a judge to entertain a lawsuit about his humiliation. But considering that he's done this several times - this is not his only paint-faced mugshot - I doubt that'd fly either.

This mug shot is several years old, and he's just now getting his head clear enough to realize he's made himself a laughing stock.

Good luck with your sobriety, sir. As far as your lawsuit goes, "lotsa luck with that."

Wow, I'm amazed that guy has gotten sober. At least he is a true American, one of his first actions was to sue people. How long until the next hilarious mugshot and what color will it be?

Rogers says Tribett has been sober for eight weeks and is making progress.

Tribett amended the lawsuit to add that he would accept three cans of spray paint in lieu of the $100 billion in damages.

I don't think Tribbett was behind this. He said himself that he didn't even know how famous he was on the internet until recently. I think his new fancy lawyer saw a naive struggling addict and thought he'd get himself a nice payday.

People who are just sobering up usually don't like a lot of drama or stress. They know it's bad for them. And from the interview I saw with this guy, he just doesn't sound like the type to launch a big lawsuit like this.

There are two different scenarios where you might make some money from the pictures but still don't need a model release. These are a) art, which is expression permitted under the First Amendment, and b) news, which is appropriate dissemination of information permitted under the principle of a free press. So let's say you heroically rescue a baby from a burning building. A photographer snaps you doing it, and the picture is all over the papers, TV, and internet. Tough cookies, hero-they can do that: you're news. A few months later, the picture (which is, let's say, oh so arty) shows up in a museum show with a bunch of other arty pics. They can do that too. A year goes by, and suddenly your picture is the basis of a national ad campaign for smoke detectors, under the heading, "I sure wish this baby's parents had purchased a Wizmo!" They can't do that. Well, they can, but you're entitled to a piece of the action. Sue 'em, honey.

The photos themselves are public. You can use them for editorial purposes. However, what he is suing for is the use of his image for financial gain. Under US copyright law, you can't do that without his permission regardless of who owns the copyright on the photos. I think that he might have a case, but how much he can recover remains to be seen. He will certainly be able to stop them from using his image.

This story was in the same paper yesterday as the one that was posted here. So I saw it yesterday....and I still think the lawyer is the fink here.

Addicts are like children. When they first clean up, they're just like little kids. Very easy to take advantage of. Believe all kinds of pie-in-the-sky stuff. After all, they're straight, right? Anything can happen! The world is beautiful!

/I should know--I got married right after I sobered up. Dumbest move of my life.

Not an expert, but I think "public domain" shots, including both mugshots and photos taken in public and used in a newspaper, are not free to use by companies profiting from the image.

I believe anyone can photograph you (in public), the news can publish you, and the Internet can parody you, but no one can use you to sell soup.

Anyone able to confirm?
