Well, the article says it happened after 2 AM, so chances are it wasn't right after dinner. Having a child in her car will be hugely influential; she will not likely see dropped or reduced charges because of it.

A wee bit more info here. The cop alleges that he stopped the mom to pass of the kid from the drunk dad and the 2nd DUI hilarity ensued. Very nice picture of what a light bar on a cop car might look like if you are stopped by the police too.

Considering how easy it is to wait an hour or so before leaving, having a .080 isn't really excusable. You're still an impaired driver, and women have a lower tolerance for alcohol. Easy way to avoid it? Grow the f*ck up and wait a little before driving.

No, but that's kind of a here by the grace of inserthigherpowerhere go I. Like all bartenders, I have sent customers out the door that were too impaired to drive. I've done my best to avoid it, but it happens.

Oh yeah... and depending on what state you're in, I guess, DUI and DWI are completely different offenses.

In Texas, getting a DUI is not near as bad as DWI.

Point. Here's another.

Let's burn down all the bars AFTER we let the government sue them out of the market and take all their assets for revenue and then we'll start on the cinemas cause that can get people worked up and then we'll only allow driving to be done by parolees and we'll pay them out of all that revenue to chauffeur us around and every so often, they'll get pulled over, too and strip searched. And so will we. Then the cops will take our wallets and money for riding under suspicious circumstances.

Then we can all go to the courthouses in our counties and burn them to the ground. Beats watching soaps.

/against drunk driving, wish cops actually cared about that and not the revenue.

0.08 is not impaired to drive for many, which is why it's difficult for people to make the call.

It is too impaired to drive ... in the eyes of the law. If you are going to drink, don't drive. It just doesn't make any sense to spend upwards of $6000 in fines and court costs, attend 150 AA meetings and $75 a month on an ignition interlock system. The mental and emotional costs of hurting yourself or someone else are to expenisve to try and tabulate. Love the law or hate it, live by it. Key word: LIVE.
Please believe me when I say one or two drinks most certainly does change the way a person behaves; however slight those changes are, they exist. I've been a bartender (and a very conscientous one) for 17 years now. I've seen what alcohol can do to a person and their decision making skils.

I remember one time I went with my Dad to traffic court where he was going to contest a ticket.

The bailiff read one of other attendees' names (let's call him "Mr. John Doe"; his actual name was a pretty unique-sounding foreign name). He was contesting a speeding ticket. Judge decided he was guilty of speeding, and fined him. The bailiff read the next persons name: "Mrs. Jane Doe", also charged with speeding (both of them were going 10-15 miles above the speed limit). The judge did a double take, and asked if she was related to the previous guy. She said she was his wife.

To which the judge replied, "The family that speeds together, pleads together," and gave her the same penalty.
