Full video. CNN is only playing the most dramatic part.

Guy was aggressive and most definitely drunk. A passenger on the train tried to get him off the train & the BART cop took over. Looks like sheer momentum drove the guy's head through the glass--does NOT look intentional in the least. And even after being driven through plate glass, the guy is on the ground and STILL resisting.

And that window broke like normal glass. Reinforced glass does NOT shatter that way in the least. Biased article & news report are biased in order to get the most dramatic, inflammatory reaction possible.

Goddammit all to hell, I HATE American MSM.

looked like teh cop was calmly walking him over to the window and when they got close the cop pushed him harder up against the window, breaking it. don't know what led up to the video, but the guy didn't appear to resist until after he was smashed through the window. he struggle after that, but if i just broke a window with my head i'd be pissed too

I meant Fark headlines in general--you typically expect them to be inflammatory, ESPECIALLY in the Politics tab, and that's okay. This headline & the one from TFA are fine. The article & news broadcast itself are what were inflammatory. CNN should have run the full video that I posted instead of taking the most dramatic moment out of context in order to create the most outrage.

You sir are retarded. That cop shoved the dude's head through the window. Any drunk jackass can expect to get manhandled by an arresting officer, but the officer didn't need to do that to subdue him. Hell yeah that was excessive force.

Imagine if the dude was black, though...Jesse and Al would be en route in their private jets paid for by for-profit charities...I think clips like this show that everyone gets abused by a-hole cops, even if for the most part they bring it on themselves.

A minor correction: It was actually the guy's arm that broke the window.

I'm sure that this case will be far less likely to be swept under the rug than most, given that there's another BART cop who's about to go on trial for murder for killing that unarmed guy on New Years.

Well, perhaps if the cops where not working so hard to cover up and/or defend all their other asshole actions, the public would be behind them. But given that just about everyone hates cops nowadays, Republicans, Democrats, teenagers, senior citizens, people of all races and nationalities, CNN made the sensible choice to pander to the 99% of the population that aren't police officers or their family.

After watching the video, I conclude the passenger was a drunk, douche-like creature. The officer was well within reason to place such douchiness up against the wall. The wall being glass and breaking seems accidental.

However, charging the drunk douche with assault is a whole new level of douchiness.

If the person was resisting arrest, and the officer was being reasonable in his attempts to control or subdue the suspect, then generally the suspect will be liable for the officer's injuries.

Which video is that - the edited one shown on CNN, or the full one where the guy is yelling "who wants to play king of the mountain", acting belligerent, threatening people on the subway, etc.? To me it looks like he drug the cop toward the window and momentum took them both through it, not the other way around. Also, if you watch the original video, most of the bystanders are firmly in the cop's corner. Usually when you see a policed brutality video it's the other way around.

Not saying police brutality isn't a serious issue, but sometimes with idiots like this guy, I hope for a cop to come along and beat some sense into him. Civilians don't get to do that without going to jail, even though it's needed and warranted quite often.

Yeah, I think you make a good point. It does appear the guy's flailing hand is what broke the glass, and the Officer certainly didn't appear to be trying to force the guy into the window. I agree with the your theory that it was accidental and that the perp didn't do anything to deserve the assault or even a resisting charge from what is on this video.

Unfortuantely, it's up to the courts to decide upong the appropriate punishment and administer justice via sentencing - not cops. Deciding to "beat a little sense" into someone isn't the the officer's job description. Couple of cops tried to "beat a little sense" in to some folks at the gay bar here in Ft. Worth - maybe that was ok too, right? I mean, it doesn't make sense in the cop's mind to be gay - so he should have plenty of latitude to straighten (pund intended) out any citizen (law abiding or not) to make them see things his way.

If you watch the full video the passengers applaud when the BART cop takes the guy off the train and one asks if he is ok medically or needs backup and another guy gets a cloth for him presumably because of the cuts from the glass. Doesn't sound like police brutality to me.

I am not one to defend cops, but I dont' think he put him through the window on purpose. If you watch the whole video, the guy was being a drunken asshole, who was clearly looking for trouble. If the officer had dragged him out of the train, slammed him to the ground, and put cuffs on him, I would defend every one of his actions.

That being said, charging the guy with assult because the cop rammed the man's head through a window is the sort of crap I expect from most police. The officer had pretty much total control of the drunk, and chose to slam him against the window.

Charge him with the public intoxication and be done with it.

but if you watch the whole video theres a part where a cop is explaining the situation and says the dudes arm broke the glass. if you watch the video closely you can kind of imagine it too. and most of the cuts were on the dudes arm, not face

he said theres no cuts on his face which are consistent with break glass. those cuts are on his arm
