The problem is that we've developed this idea that our lives should be perfect, especially physically, and if they're not, it's somebody else's fault and they should be made to pay. It's a lot like the idea that sickness or death only happens because of sorcery and the person who caused it should have to pay. The only difference is that we call the people who exact the payment lawyers instead of witch-finders.

I hate to be the killjoy that points out the possible logic in TFA. It was at a beauty school. Those gallon jugs of shampoo they use are really heavy. If one of those fell on her head while she had her head in the shampoo sink where your neck is braced by the edge of the sink and your head just hanging out there, yea this could be a problem.

I doubt anyone is going to volunteer to hang their head over a ledge and let someone drop a 15# weight on your head. Well this is Fark so we might get some takers..

The lady might not be that big of a dumbass.

Her name was spelled Shi'thead.

My sister, being oblivious to the apostrophe and the obvious pronunciation, called her shiathead.

Yeah, this lady is trying to play the lawsuit lottery. The difficulty here is proveing that whoever dropped the bottle was somehow criminaly negligent or that the school was negligent. Not going to happen. Sad thing is, I bet the school settles for some ammount of $$ thus enableing others to try similar scams.

No one is arguing that. But accidents happen. The lawsuit is going to have a difficult time proving negligence, or nailing the school rather than the individual that dropped the 'poo.

They shouldn't, but they shouldn't be on the hook for anything more than immediate medical costs IMO. Unless there is a doctor who is willing to testify that this lady is going to have ongoing problems (not indicated in TFA), then I call shannagans and this lady is just trying to milk the sytem for some extra cash.

So, why aren't you suing me for the degradation of quality of life, however small, that my farts are currently causing you? While it is true that I am probably 8000 miles or so away from you at the moment, the amount is nonzero and you are clearly not at fault. Furthermore, I had the choice of eating different food - so my toot tort was in some sense deliberate.

Or maybe, just maybe, most of us realize that the standards for actionability needs to be just a bit higher in the USA and just a bit lower in many other countries. (In western Europe, for example, companies have little to no incentive to changes their mendacious ways as a result findings of lawsuits by individuals of gross negligence in specific cases. In eastern europe and India there is often no effective legal recourse at all, and in some places like China and Russia, seeking legal recourse often makes the situation worse for the seeker).

www.overlawyered.com is a right wing nut job politically, but he's dead on when it comes to tort reform.

Well, let's not assume she was in a vulnerable position like that, the article doesn't mention it. Heck, at the salon I go to (we don't have any good ol' barber shops around here that I'm aware of), they've got shampoo bottles at the hair washing stations, in the waiting area, in each hair cutting station.

They try to push that crap on you to bump up their profits. She could easily have leaned against a display, causing a bottle to fall on her head. It's just as likely as your scenario.
