it is only fair since you can't ask about whether the person is in the country illegally either. that would be racist.

doing a criminal background check would not be fair since it isn't the person's fault if they are a criminal or have an outstanding warrant or something else. it is society's fault.

The guns that we're talking about here are by and large stolen guns. Some guy gets arrested for committing some kind of crime. The cops check the serial numbers on the gun and whaddayaknow, it's been reported stolen. The gun gets confiscated, the perp is behind bars (with an additional stolen firearms charge to boot)... Now the most recent rightful owner, the guy who filed the police report with the serial numbers on it after his house got burgled, is supposed to get subjected to the additional indignity of a NICS check before he can have his stolen property returned to him? Outrageous!

The police aren't gun dealers and have no statutory authority to use NICS for the purpose of running background checks on people before they get their stolen property back. Do the police run a NICS check on you before giving back Grandma's silver necklace or your '92 Chevy that got nicked from your driveway? Nope... and this is no different.

NH Department of Safety is completely correct here.

Agree. I doubt that a felon would report a stolen firearm...leave that activity to those who report that their drugs were stolen.

Now, I wish they ran more checks before the original gun sale honestly, but it sounds like in this article it was rather pointless.

As someone who spent a fair amount of time growing up on the south-side of Chicago, and has lived in more that a few neighborhoods back in the day where I heard gunfire regularly, I can say with certainty if someone was flashing something that looks like a gun, I didn't stick around to see if it was something otherwise.

As a resident of Texas (a lot like New Hampshire, but the good folks here are not douchebags, and you can... well, you can water ski), I can pretty much guarantee that if some gang-banger "brandished" a gun shaped lighter he would wind up with a 3rd eye socket directly between the 2 he was born with, and the shooter would most likely be no-billed.

firearms, there was some legal issue that allowed them to do so
and if there are no longer any legal issues preventing them from
having their firearms, they should be immediately returned.

I'm guessing the problem is that the cops are purposely dragging
their feet on returning any firearms, claiming that they don't have
the time and/or manpower to run a timely NICS check.

And our illegals are just a couple of confused Canadians wondering where all the Tim Hortons went.
