That's why you'll never find a "real" citizen charged with this. Homeless people tend to not hire aggressive attorneys that really want to test the constitutionality of their charges...with a few notable exceptions...but in general, law enforcement can treat certain classes of people as lesser citizens and make up bullshiat charges that don't get challenged for years.

I've personally been pulled over for jaywalking when I stepped into the gutter to get around a light pole. When you fall outside of the "real citizen" category, cops generally do whatever the hell they want with little repercussion.
Get used to it, this won't change any time soon.
