I suppose by not wanting to be held down and forcible catheterized he could have been obstructing justice. Of course, in this case, the justice will be served when this officer's behavior comes to light and their department gets sued...

When I had to take my DUI classes, someone asked the cop who was giving a lecture if we refused to give a blood or urine sample what would happen and the cop said we'll get three or four guards and hold you down and draw your blood by force. Something about when you get your license you surrender your right to refuse. In Nevada anyway.

Its called Implied Consent. When you agree to have a drivers license it is implied that you agree to give blood/urine if needed for thh investigation of a DUI. Most states use this. Its interesting that the officers got a warrant, and that a state's attorney and a judge moved fast enough to issue the warrant. If the guy was unconscious from an accident they would have just taken his blood. I'm guessing if he got a catheter he had been acting like a major jerk and pissed off a lot of people.

I would suspect that this was not the accused's first brush with the law. Cops may have been trying to get him on some charge, any charge just to make his day more miserable. Still doesn't warrant the extremes they went to.

I would honestly know some more about the legalities in this matter. Being strapped to a gurney against your will and being forced to undergo a blood or urine test should have legal repercussions.
They are doing what is called "no refusal" weekends here where they will do just that if refuse to take a test to determine your BAC (regardless of drinking or not)an officer will go to a judges house and obtain a warrant for search and seizure of your fluids.

Any lawyers out there?

Occam, I'm sorry that reality troubles you so much, but in the real world that the rest of us live in, justice is a rare commodity. You can thank the pukes over at MADD for a lot of this nonsense, but there is no need to get personal over this, just work with your legislators to get some rights back.
