That was then, this is now. Nowadays many adoption agencies don't require you to have a religious affiliation in order to adopt a child. There are some exceptions, such as agencies that are operated by religious organizations and not even that is set in stone.

This. So much this. If I type anything else, I will so explode with anger.

FTA...In an extraordinary decision, Judge Camarata denied the Burkes' right to the child because of their lack of belief in a Supreme Being. Despite the Burkes' "high moral and ethical standards," he said, the New Jersey state constitution declares that "no person shall be deprived of the inestimable privilege of worshiping Almighty God in a manner agreeable to the dictates of his own conscience."

I wonder if that's still part of the New Jersey state constitution.

2009-08-23 04:00:29 AM
So will tomorrow's headline read "Camarata steps down from bench", or should we pretty much declare the American experiment a failure and start over?

Bathia_Mapes: I wonder if that's still part of the New Jersey state constitution.

Unless they changed it in the last couple of months, yes. The case TFA is talking about is a current one. If that judges ruling stands, he has ostensibly made it illegal to raise children if you are atheist, agnostic or just irreligious.

The case is from 1970.

Your Faith is Creepy: The case is from 1970.

D'oh. I thought the headline had a typo. So the lesson here is that TIME put all their back archives on the web?

From another blog posting here:

Fortunately, their appeal, granted 1 July 1971, was successful.

"The judgment of the trial court is reversed. Since the sole ground for denying the adoption was the Burkes' beliefs regarding religion and it is clear from the record that they are otherwise fit, we grant the adoption in the exercise of our original jurisdiction. See R. 2:10-5; In re Adoption by B, supra, 63 N.J. Super. at 104."

Man ok, this threw me:

"Last year the Burkes presented their adopted son, David, now 31, with a baby sister, Eleanor Katherine, now 17 month"

I thought what I was reading was something which happened to them in the 70', and now some 30 plus years later it was happening again.

Teach me not to stay up late and post on Fark while drinking, why don't you submitter

Dumbass subby. Yeah, I didn't notice the date on the article either.

Man, I hope the Apollo 13 mission goes okay.

Those of you who think this is old, re-read the article. Reading comprehension, it's not just for kids. And those calling subby a dumbass, you just proved you are one.

Pretty sure you're just being a jackass, but first two lines from TFA:

The Law: Can Atheists Be Parents?
Monday, Dec. 07, 1970

I'm still pissed off about the Controlled Substances Act. Nixon, that f*cking fascist... Thank God the whole thing is unconstitutional as hell, and it'll be off the books within a year.

What do you mean "fascist"? He's going to end the war! He said so!

An interesting snapshot of the era in our nation's history where everything went completely off the f*cking rails. Ugh.

Hard to believe any judge could possibly say this in 2009. He should be removed from the bench.

38 year old article is 38 years old?

I was pulled over by a cop for speeding, and the form he filled out about me asked my religion...
/// so much for separation of church and state

Thankfully this was 1970 and not today.

Still sickening it even happened then...

/Though in a bible-belt state, it wouldn't surprise me if it did still happen today.

2009-08-23 10:19:39 AM
This submission is VERY misleading.. I also thought this was from a current edition of Time magazine, and assumed the 'last year' comment was meaning 2008.

I found this on Stumbleupon as well, which is where I'm guessing the submitter "stumbled-upon" a 30 year old article to submit to Fark.

The Icelander: From my cold. Dead. Hands.

This. My hopes of adopting a child are pretty much dashed now that I'm a single parent, but I'm trying my hardest to raise a moral, ethical woman...and I'm doing it without religion.

The war against Christianity and the unborn (or in this case recently born) continues.

Well we're still technically not aloud to take office in many states.

REGARDLESS of the age of the article, athiests and homosexuals should NOT be parents. The kids they already have should be taken from them by the CPS.

Bathia_Mapes: That was then, this is now. Nowadays many adoption agencies don't require you to have a religious affiliation in order to adopt a child. There are some exceptions, such as agencies that are operated by religious organizations and not even that is set in stone.

Yes, but if you are homosexual, plenty of states won't allow you to adopt or foster care.

2009-08-23 10:22:49 AM
Yep, if you page through you'll even find 1970 letters to the editor.

It's amazing people don't look at the dates, there are no fewer than a half dozen "outrage" sites that have picked this article up in the last year thinking it's a contemporary story.

2009-08-23 10:26:00 AM
By the way, this was reversed on appeal. The decision is here:

http://www.americanadoptions.com/adoption/article_view/article_id/2435?pg=1

Unanimously, although some of the justices had different reasons for their analysis than the official opinion.

2009-08-23 10:27:05 AM
Tell me why I care about an article from 1970? Shouldn't the outcome be more important?

2009-08-23 10:27:47 AM
I don't think they should be able to adopt. Their lack of morals and enormous egos will influence that child to the point where he/she would stand a good chance of burning in the Pit for all eternity because they reject Allah.

That's because it's totally plausible.

Can you please tell me what this even means?

"the child should have the freedom to worship as she sees fit, and not be influenced by prospective parents who do not believe in a Supreme Being."

Free to worship as she sees fit...as long as it's within a state's definition of 'fit.' Great. That's some freedom.

I'm sure the right wing will jumping up and down about individual right and freedoms in this case. Keep your government off my morality and all that. Right? Right.

If they fail in their appeal, Eleanor Katherine may have to leave the only family she has ever known and await adoption by another couple whose religious convictions satisfy the State of New Jersey.

Why does it always seem like an endless fight to not be dominated by insufferable douchebags in this country?

It means that atheists aren't Americans. A sentiment shared by at least one former president.

FTFA: the New Jersey state constitution declares that "no person shall be deprived of the inestimable privilege of worshiping Almighty God in a manner agreeable to the dictates of his own conscience."

So... in other words, if your family is Jewish and your adopted 10-year-old wants to be a Muslim, you are required by a religious freedom clause to go to mosque with them? How's that make any sense.

/What do you call a lawyer with an IQ of 70?
//Your Honor.

It means "Pick a side, we're at war."

You know, I wonder what would happen if people applied the same "logic" to other rights. Say, "Freedom of speech, not freedom FROM speech." Stand up and air your innermost thoughts or go to jail, citizen!
