Female student/female teacher MAY get jail time and a lot of interest.

Male student/Male teacher must be at a catholic school.

So what happened to the 27 year old? I'm assuming he got rid of it so he's ok, but still. . .

At least she didn't just have them on her phone. I think if they are underage and take pictures of themselves and don't send them out, there is no crime. Hell, even sending them to kids their own age shouldn't be an issue. It's stupid as hell, but we can't stop hormones from taking over, so why try?

The Clearfield County District Attorney, Bill Shaw Jr., says even when a teenager takes naked pictures of themselves, it's still considered child pornography and could be a felony.

so if a teenager took some naked pics of themselves and mailed them out to every member of the state legislature.....we could arrest ALL of them for dealing in kiddie porn?

The 27 year old is facing charges also. According to the interpretation of "possession of child pornography" by the police officer in the newscast, he considers her guilty of "manufacture and possession of child pornography" even if she doesn't send it out. If she sends it out she is also guilty of Distribution of Child Pornography. The world we live in...wow.

Good point. Would they all be in possession of kiddie porn? I suspect the answer is yes. I'm not a child anymore or I'd send them all pictures of my penis to see how this would pan out. I think it's legal for me to send WIE as long as its to other adults though.

There was an interesting essay in "Newsweek" about this. The headline was something like, "If a 15-year old girl sends naughty valentine's day pictures to her 15-year old boyfriend, is it really child pornography?

So what if the pictures are unsolicited? This is a *hypothetical* situation of course. . .

I have an employee thats 17. His girlfriend is 17. If he drunkenly sends me a picture of her topless one night without provocation and I delete it immediately, i'm still brought up for child porn? If that is the case then we need to put Weavers plan into action. Different situation need different handling.

It's an idiotic implication of the laws as written, but no politicians going to change it, because doing anything seen as weaking child porn laws in any way is political suicide.

Being that it's legal to produce porn, but illegal to solicit a prostitute, what if you went up to a hooker said I'll pay you $200 to have sex with me and let my buddy film it, wouldn't you both be safe from prosecution?

Most states have a policy that people cannot be convicted of crimes that were designed to protect themselves as a class. A 15 year old girl cannot be an accessory to statutory rape.

Seems like a sensible policy to me. Is that not the law in Pennsylvania, or is the state attorney a retard?

are you kidding? this is Pennsylvannia. Not only does the state government have a LEGAL MONOPOLY on the sale of liquor, but it's still possible to have a 3 car pile up on a major highway after colliding with a horse and buggy.

the legal system is still not sure how to handle these 'magic boxes' that people speak into from time to time. And that new fangled 'intertube' thingie is just completely mind blowing to the state legislature. They keep trying to find out who owns it so they can tax the bastards.

While the average 56 year old procescuter still feels guilty about viewing skinemax in a hotel room while away from his wife.

Those of us in the middle (around 32 like myself) have seen this divide growing between the two camps. And from my position it is going to get much worse. 10 years from now you are gonna have every teenager in America upload HD porn of themselves.

In the end you simply can't put half of the teenage population in prison for child porn charges.

Much like the RIAA and music, this battle was over from the beginning.

We most prosecute child pornography to the highest order of the law so that we can protect these young and innocent from the diabolic evil doers who seek only to exploit them. If young, sexually-mature-but-legally-not-mature men and women photograph themselves, then we must act swiftly to protect them from themselves. We must give them adult criminal records to deter them from ever harming themselves again and further slandering the image of post-pubertal non-adults! We must ensure that these acts are prosecuted to teh same extent as more serious child pornography acts; the end result should be to do as much or more negative harm to these indiiduals as we purport they have done to themselves. We must also rely on technicalities to make sure there is no confusion between willingly sending a picture and 'consenting' to have their picture taken -- even if they are their own photography.

I know some people are going to say that this is not true and I understand that a 5 year old can't make all of his own choices correctly...but come on...16, wake up! that is old enough in most civilized societies.

Age bases laws only exist so that the enforcing bodies can make a profit enforcing them. If you are mature enough mentally to have sex, drink, drive, or whatever at age 12 so be it....if you are an immature arse at age 40 and can't do those tings responsibly so be it....EITHER WAY WE DO NOT NEED LAWS TO PREVENT IT.

My buddy was working on his daughter's laptop to clear up some malware she had on it...

long story short, he comes across a folder labeled "nude pics for brian" or whatever his name was. She didn't exactly try to hide it...so he opens it up thinking "WTF?" and sure enough, dozens of pics of her fully naked, spread eagle, everything.

I thought it was kinda hot, but then again I'm not her dad. If I were him I'd whoop up on her boyfriend and her.....
