What I'd like to see them prove is that this person actually downloaded what they say they did. Can they prove that the mp3 files in question were copyrighted music at all, and not something else?

Sounds more like a publicity stunt/scare tactic to me.

He has 600 MP3's and they are making a big deal over that. shiat I have something close to 1.5 Gigs dedicated to my shared folder. I doubt they are going to come after me though as most of my stuff is just obscure crap that is hard to find like Tori Amos and Maynard James Keenan doing "Muhammad my Friend" live at 256kbits/s and other such stuff.

This is a fight the RIAA cannot possibly win. The internet has allowed the consumer market to become aware of how badly they get screwed by corporate america, and we outnumber them millions upon millions to one.

They are going down. We know it. They know it. This is simply the last, grasping breaths of an anachronistic corporate hold on media in an age where anything is simply a click away.

As the article said, prosecuting individual offenders is a legal club the RIAA has yet been unwilling to use. Undoubtedly it would provoke outrage.

That is, however, their ultimate goal. They know that the accomplish it, it must be done in steps. This test case forced Verizon to reveal identity information to a copyright holder.

Once they're inundated with subpoenas as a result of this ruling, Verizon will set up a webpage where an RIAA rep can look up an ISP user's information. Better automate so we don't have to pay much to handle all these requests right?

But wait, then Verizon realizes that the only reason they want this information is so they can go to court again and ask a judge to force Verizon to cut the user off.

If the RIAA wins that, Verizon soon automates this process to speed up and reduce cost of enforcing it. Then guess what? You log onto Kazaa, the RIAA sees your IP, they do a few clicks and you're cut off. Why shouldn't Verizon give the RIAA direct access to cut off it's members? If they fight it they'll lose, which is the purpose of these test cases.

So ya'll act like it's no big deal, and I know it's an exaggeration somewhat to believe that Verizon would automate this, basically giving the RIAA a button to reduce it's subscriber count - so Verizon would probably make it difficult for them, for a while. But obviously it's all about money for Verizon, so we can't see this possiblity as too far off.

Using Kazaa or anything like it in a way against the RIAA's (or any other copyright holder's) wishes will subject you to an immediate disconnect, with the RIAA on the hot button.
