Obscenity charges seem to be based upon "community standards" laws.

The problem is that with the internet we are one giant community that pretends we are localized communities in different states or even in different areas within different states.

This will be thrown out on appeals but these types of prosecutions are extremely scary. All First amendment arguments aside (and I agree they are the most important arguments), the ability to prosecute someone in one place for something they did completely legally in another place because digital information happens to pass through some of the infrastructure in that particular area is a bunch of BS.

I will personally be donating to this persons defense as soon as I can find the genuine link for collection.

Wasted Pixels: So this guy's shtick was that he banged girls who pretended to be underage? If that's the case, I don't know if I necessarily agree with his conviction (a crime typically needs an actual victim), but man... what a farking creep. I'm not saying I believe in obscenity laws, but if I did, that would sure as hell fall under them.

Are the women who willfully participate in his videos, especially the ones who pretend to be underage, not creeps as well?

Or do you subscribe to the double standard?

bbcard1: While it is an interesting debate, let's not start making Max Hardcore to be Patrick Henry. We live collectively under a code of agreed upon laws...we have the freedom and mechanism to change those laws, we have the obligation to understand the laws...the first amendment is not a blank check.

You must be one of the misguided masses who believe we have a democratic government, we do not.

spasemunki: How can something be a reasonable law if a person can't ever know in advance if their actions would constitute a violation of it? If you misjudge the tastes and mood of your audience, you should be filing for bankruptcy, not going to prison.

Well, then, never, ever put porn on any kind of torrent system. One of your "servers" (and you know they won't care about the finer distinctions) will reside somewhere where whatever you do, no matter how tame, is illegal.

So? farking children is disgusting and illegal, but that's not what's going on ; he was farking a porn actress pretending to be underage. It's repulsive, but as long as she's really an adult, I don't see that the government has any standing to prosecute the man for that.

C'mon, it's 2009; we still have obscenity laws? Xtube had better watch its ass.

I can see how he was convicted, though; older, religious people have trouble distinguishing fantasy from reality, so I can understand who they would not be able to figure out that acting out an underage fantasy is not the same thing as actually shagging an underage person.

I have a question--why is a sex act like a Roman shower, which is extremely nasty (IMO) yet medically harmless, illegal, yet bareback porn, which can transmit an incurable and fatal disease between actors, is legal?

Max Hardcore... I've read that name before..

In one outtake, Max's victim gets an golden arc of stinging urine straight in the eye, where it sticks behind her contact lens. She lurches back, wincing in obvious discomfort. As she rises from the cement floor of the truckstop restroom, cameras and lights are set aside.

"It's in my eye," she balks. "I'm wearing contacts."

Max is not amused with this delay. "Is it just foggy? Do you need water? Is it life-threatening?"

"No," she replies, annoyed.

"Then pull your panties down. And listen, let's get one thing straight. There's only one guy who calls cut on the set, and that's me."

"Try being a little easy, please," she implores.

"I am being easy," Max barks, letting loose with a angry torrent of urine. He deliberates splashes it up and down her face, pulling her hair back with his free hand. She purses her smeary lips together, angry and humiliated.

Why, of course, it was in the Rotten library!

"[T]he fact that society may find speech offensive is not a sufficient reason for suppressing it. Indeed, if it is the speaker's opinion that gives offense, that consequence is a reason for according it constitutional protection. For it is a central tenet of the First Amendment that the government must remain neutral in the marketplace of ideas."

THIS.

Old max is a farktard for sure. The why he is in jail is very important. He violated community standards for obscenity, hmmm slippery slope there. He's in jail for doing something unpopular but not necessarily harmful to society (like stealing). This guy like Neo-Nazis are low hanging fruit, nobody like them and they are easy targets. But you have to ask yourselves who's next after the easy low hanging fruit is gone?

Sgt Otter

I find his films repulsive, and oddly, boring.

Because you find them repulsive you find them boring. All porn would be incredibly boring if you didn't find it arousing. Suck this, lick here, insert this, blow a load here, repeat. It's the titillation and arousal that makes porn interesting, otherwise it's like watching gymnastics or dance, not terribly interesting to most people.

I would imagine basement dwellers who couldn't get laid if they tried could easily be into that type of stuff. Is it really that much worse than pulling a cock out of some chicks ass and then putting it in her mouth? That's quite common.

All true, but what happens when the low hanging fruit like max is gone?

2 things first what max was producing will go underground with "actresses who aren't necessarily volunteers and maybe even under aged.

Second the busy bodies WILL find someone else to go after even though many of those busy bodies are secretly wacking off to under aged and other blackmarket porn.

That one?

Yeah, kinda unsexy.

Why would someone want to, ostensibly, abuse or otherwise physically "punish" someone who's blowing them?

LOL. Yeah, that's the one, haha, that's some great onomatopoeia there. I always thought it was more about ego stroking than anything else, like saying "ooooh you're so big!" It's like "this dick is so big it's provoking my gag reflex." But either way it is a mood ruiner for me.

what a shame...

Alot of people are going to say like he SHOULD be in jail and the like. You didn't know him, but I did.

While he was quirky sometimes and our views didn't match up exactly, he is still a great guy and treated his employees better than many of you could imagine. For instance, he bought me a laptop to keep even after I quit working for him, not many bosses would do that.

All you out there saying this is a good thing for him to go to jail, it's easy to judge him from what comes through in his on-camera persona. It's a hell of alot tougher to say those things when you personally know him and realize he's actually a really nice guy.

Really pissed off about him having to go to jail for this bullshiat, but we all (especially including him) knew it was coming sooner or later. The government has had it out for him for years & years. If you play with fire long enough, eventually you will get burned. =(

See you in 2012 Paul.

Then I could legally make my family shut up about Christianity in general, or at least Catholicism, or perhaps their gross misunderstanding and ignorance of the Bible as shown in their lack of contextual information, correct quotation, discrepancies and contradictions in the text, the fact that it was canonized by "nobles" voting on it... and that this was "founded as a Christian nation" even though historical documents by the framers explicitly deny this notion.

As to the target; it depends on the district you live in. If you are liberal in a conservative district you are farked; if you are conservative in a liberal district you are farked. The busy bodies won't be able to help themselves they are like predators and these predators only go after the weak and the unpopular. Locking up Max hardcore is just opening up a pandora's box.
