Minimum wage (or near) jobs are not that hard to come by... this was a risk he took by participating in a pornographic film. I think the proprietor has every right in the world to terminate his contract, and he would be better off by finding his next job at Blockbuster, Taco Bell, or Staples (or anything else similar.)

And seeing how Federal Law which this is always above state law so the at-will employment has no effect and can not be used in defense in court if this man decides to file a law suit against subway. Personally I would like to see this young man call the ACLU and tell them about what subway has done, this is textbook discrimination.

He doesn't really have a wrongful dismissal case if he lied on his job application and left out his gay porn work. If it was long enough ago (usually 5 years) that is was expired work experience, then he has a case. But if the gay porn aficionado customer could recognize his face from his work, then it is doubtful that much time had passed.

...unless the customer identified him in some other fashion....wide stance perhaps ?

Huh? I don't think he should have been fired, but ignoring that for a sec... Most states would have required that the ex-con disclose that on the resume form, and he'd never have gotten the job at all. I do think there should be more protection in some cases when convictions have no relation to a non-security sensitive job (ie. not a pharmasict, child care worker, bank security, etc)... but most states don't protect that at all. In addition, there's probably better arguments for not hiring an ex-con than not hiring a gay or porn worker, so I'm not sure what you were hoping to hear...

That's probably for Federal and State jobs, not private companies and franchisees of Subway. I looked at their "discrimination" statements for employees and owners and found nothing about discriminiation against sexual orientation in their clauses.

the thing is, nowhere does it specifically say that the guy was fired because he was gay. the man said he got fired for being in gay porn, but why is someone who watches gay porn enough to recognise the actors demanding that someone be fired because they are gay. i think it is more likely that the man complained because the guy is a porn star. i rele dont think subway necessarily did anything wrong. not only was their decision legal, it isn't even clear that it has anything to do with the fact that he is gay at all.

I doubt you could fire someone for previous work they've done (otherwise you wouldn't have hired them in the first place)... and you can't fire someone for their sexual preference... so that means the tipping point was the lone guy saying he was going to boycott the store... but you can't just fire someone and say "We're firing you because this one guy said he was going to boycott us."

So what was Subway's reason for firing him? Unless it was a work-related thing (constantly late, bad attitude, rule-breaker, etc), I would assume that firing him otherwise would have to be breaking some sort of rule somewhere.

So these guys support the guy, saying that Subway has no business complaining about his porn adventures, by photoshopping hardcore pornography into a subway restaurant. I guess that really drives home the point that the subway manager was completely unjustified in fearing his employee's porn past might tarnish his restaurant's name.
