It wasn't a mistake.

"Duke said the independent gas station lost a lot of money. Just how much is still being tallied."

Now you know how the rest of us feel....

2008-08-15 10:54:27 AM
No one reported the mistake?

Where's the obvious tag when you need it?

2008-08-15 10:56:30 AM
TFA: "pump malfunction"

Fat fingers.

2008-08-15 10:59:03 AM
The mistake they should have reported should have been what the gas station intended to charge and not the price at the pump.

2008-08-15 10:59:45 AM
I can't believe people. I would have reported the problem right after I filled up. It's the right thing to do.

2008-08-15 11:00:37 AM
It's Texas, according to their own Supreme Court the average IQ is lower there.

2008-08-15 11:01:01 AM
People definitely reported it - to their friends and family.

2008-08-15 11:01:17 AM
I likely wouldn't have even noticed. I pay at the pump, use the same grade gas same gas station. I don't even look at the price much anymore, no need.

2008-08-15 11:01:38 AM
BAH! When I read the headline I read it penis pump... Dont know why.

2008-08-15 11:01:53 AM
I think they should raise gas prices to compensate for the loss of profit. At least I would find that highly amusing.

2008-08-15 11:02:54 AM

Manager Jim Duke at a Dill Food Market says that grade of gas was supposed to be selling for $3.89 a gallon.

Surprisingly, the submitter did not end the headline with a Duke cliche.

Julieahni: I can't believe people. I would have reported the problem right after I filled up and drove 50 miles down the road. It's the right thing to do.

Fixed that for thee.

2008-08-15 11:03:25 AM
Didn't they used to approve credit transactions from inside? I guess they got rid of that because it was a pain in the butt but I somewhat remember that you had to wait for someone inside to approve the credit at the pump back when that was first available.

This wouldn't happen in New Jersey.

I can't believe people. I would have reported the problem right after I filled up and drove away. It's the right safe thing to do.

What is a sure sign that a gas station is ripping you off?

"OPEN"

Shame on them. They knew what they were doing was stealing.
Cue people saying, "well what do you think the oil companies have been doing to us?!?!"

It's not the same thing.

It's NOT stealing if they paid for the gas. It's not the consumer's responsibility to correct an error in pricing. If the station set the price lower than what they intended to set it at, that's their own damn fault. No one else to blame. By your logic, you would be stealing if the gas station had set the price at $3.85 instead of $3.89.

Super Troopers has gas just under $2 a gallon, Farve pours out at least half a gallon just to get a free hotdog.

The guy probably made a mistake when he set the gas prices, taking advantage of a mistake is not stealing. Stealing would be if they stuck a hose down to the storage tank and filled up. These people paid for the gas at the price set by the station, its the stations fault.

we can all agree that it was pretty shady of all the people to take advantage of an obvious mistake like that.

but we can all also agree that as much as we are morally outraged, we woulda did it too.

/we're all bastards

Sin_City_Superhero: It's not the consumer's responsibility to correct an error in pricing.

The important question is the contracting parties' intentions: thus, mistake by one party where the mistake was known or reasonably should have been known to the other party is grounds for finding a sale voidable at the mistaking party's option.

Not my job to police how much the pump charges unless it's more then it says. It's like server at a resturant forgetting to charge you for something, do you tell them???

no....

2008-08-15 11:23:28 AM
Yup, woulda filled up, chuckled and left. And probably called my friends. No remorse.

I hate obscene gas prices these days.

The mistake was soon reported by a 15 year old boy who had been banging his incredibly hot teacher.

Yes. The honesty will usually get me a free drink, and one that's given freely is much more rewarding to me than one that is procured by fraud. But then, I'm not a greedy douche who'd take advantage of the innocent mistake of someone making minimum wage.

So he can, if he chooses, refund the money and then siphon out the gas from the customers' tanks?

Now waiting on the Follow-Up story when they pull everybodys Credit Card # from the machine and "correct the discrepancy".

I would tell them, but that is different. The servers are the usually the ones who have to pay for the mistake.

I wouldn't have said anything if I was getting an unintended bargain at the gas pump. Hell, I probably would've called my wife to tell her to fill up there too.

Mayor Bee: So he can, if he chooses, refund the money and then siphon out the gas from the customers' tanks?

In the past when this has come up, they've charged the customer's credit card a second time.
'Course that ain't strictly legal either...

So if I was walking behind you and saw you drop your wallet without you noticing and I kept it...that would not be comparable to stealing? Afterall, it is your own damn fault. moran. And yes, it would be stealing if I deduced that the price wasn't set correctly.

Theaetetus: procured by fraud.

Where is this fraud of which you speak?

Sin_City_Superhero: It's not the consumer's responsibility to correct an error in pricing.

No, legally, it's not. Just as I don't need to tell the person on the sidewalk that let the $20 bill drop out of her pocket.

However, there's value in treating each other kindly and with respect. That value is probably higher than $20.

I guess you can, if you're telling you're going against your own morals, but if you don't have morals then there's no fraud.
