No. It is sufficient evidence for the prostitute to state a price for a specific sex act. Actually doing the deed is both unnecessary and exactly the crime he's prosecuting.

I personally think that legalizing it is a nice idea, but will lead to exploitation as often as liberation.

I remember a while back, authorities here in Victoria (a state of Australia where prostitution is legal in licensed brothels) hired private contractors to pose as clients and infiltrate illegal brothels to prove what goes on in there.

Yes, illegal brothels still exist even though we have legal brothels listed on the stock exchange here. Why? Mainly because they use sex slaves as labour so they're much cheaper, as well as allowing unprotected sex on demand - which is illegal in licensed brothels.

Anyhow, the PIs actually had sex on the clock repeatedly as a way of fully establishing what goes on in these illegal brothels and building a case. It was all fully legit. It was only once it became public that there was an outcry and this practice was canned. Seems that some taxpayers were upset about PIs getting laid on their dime.
