The default state of rights in America is "on".

This means that we have the right to engage in action X until it can be proven that action X poses a significant threat to public health and welfare, enough to over-ride any positive benefit derived from action X.

To date, nobody has proven that allowing lap dances poses a significant threat to public health and welfare.

Therefore, it remains legal.

Oh, and someone needs to put a PI on this guy. I'd all but guarantee if you had a PI tail him for a month you'd get a photo of him coming out of a strip club. in case you didn't see it, the pursuit of happiness is in the Dec of Independance, not the Constitution.

That being said:

"We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America."

domestic tranquility comes to mind, as does general welfare.
