OZZ: How comes this isn't branded Nanny State? Or does that only applies to countries with a higher quality of life than the US.

Because it's more police state than nanny state. She wasn't doing anything dangerous, except to the tax man.

2008-01-30 06:34:34 PM
deeproy: I hope this makes it to court. I would love to see this case get thrown out.

Local Pa courts will rule against her. Federal courts? anyone's guess.

TerraSin: Correct me if I'm wrong, but isn't Ebay the auctioneer? The seller is simply that, the seller.

According to the dictionary, an auctioneer is "an agent who conducts an auction". Thus, the agent would be Ebay as they are the ones who control the auction. The seller is merely providing the products to be auctioned off.

That's what I was thinking. Do you have to get this license just to put something up for auction at a regular auction house in PA? If not, this is BS.

Gee, you think? That line was farking priceless.

God bless, PA. fark this woman. My father was an auctioneer, and then eBay opened. Ten years later -- BAM! Herpes.

Two Dogs Farking: Also, the $10 million is sensationalist bullshiat.

TFA: In an e-mail Monday, a Department of State spokeswoman said Pletz faced a $2,000 maximum fine because of two counts listed in the complaint.

Aw hell...another servile slave of 'the law is the law'...open wide and swallow down the state c0ck.

If you are setting up a business as your primary source of income, it's never a bad idea to drop a few hundred dollars and run everything through an attorney first.

I'm guessing that she made more than $2 profit on each of those 10,000 sales, so she could have afforded to talk to somebody about state laws before getting started.

Of course, it would be nice if the the state didn't go after people making money by selling stuff online...I guess...

asmodeus224: open wide and swallow down the state c0ck.

Nah, PA has a really tiny dick. That's why it has to overcompensate so much.

2008-01-30 06:38:35 PM
I feel for her kid, but if everyone who was "just trying to take care of their family" was allowed to break the law, we'd have a nation full of Mexicans.

/oh wait.

ianjames: Sounds all too familiar. The waffle house owner in paducah ky found out a former employee was selling out dated menus that were destined for the trash on Ebay.

lol! Waffle House menus ... Yes they must be as rare an valuable as the employee's collection of Nascar collector plates. Why the only way to get a Waffle house menu would be ... to go into a Waffle House and take one.

OZZ: How comes this isn't branded Nanny State?

Because an auctioneers license doesn't nanny anyone; it restricts lawful and beneficial activity.

Think.

So anyone in the state of Pennsylvania that has ever re-sold an item on Ebay owes the state a thousand bucks, or just this lady?

I have a side business auctioning things off on eBay so I'm getting a kick out of these replies.

They're just pissed off someone could make money at home on the Internet without having to report to a job like they do.

A Shambling Mound: So anyone in the state of Pennsylvania that has ever re-sold an item on Ebay owes the state a thousand bucks, or just this lady?

We in PA take pride in our ability to punish the parents of cancer-riddled children, who do nothing but clog up the health care system and annoy us with human-interest stories on the local news.

Farkin' baldies.

So if cancer-sword wasn't wielded she'd have been taken to the farking cleaners. I also noticed in the other thread that the City of Brotherly love is high on the Misery Index.

Why do you PA guys stay?

Two Dogs Farking: Blues_X: There are no words to describe the idiocy of applying that law to Ebay sales.

It doesn't apply to people who sell their old stuff. She sold other people's stuff, which makes her an auctioneer, whether she likes it or not.

Not to mention she could be breaking zoning laws. People come to her place w/the goods, she takes pictures, sells it on eBay, and ships. All from her home. Technically, that's a business. If she's zoned residential, then she gets fined. Big time.

You know what this is. It's local governments not being able to get a piece of the pie when it comes to the internet.

These people would love to tax ALL of your electronic communications and any other traffic. Individuals making money off the internet just sticks in their craw because they can't have a piece of the action.

Scaring grandmothers and stay at home moms is their weapon of choice.

Shiat, I sell on Ebay. Does this mean I need a state auctioneers license?

This is the biggest piece of bullshiat ever.

I thought eBay was the auctioneer.

This lady was just a mule for the item owners.

I guess she should've had a "do the dirty work for a cut" license.

Waited about a year, then claimed that they were his property, and wanted the profits, threatened to take it to court. Well It seems like extortion to me, but what do you expect from a waffle house owner. They are the scum of the grill.

Everyone needs to write a letter to Waffle house corporation!

On a similar note, when I worked for CDW, the vendors would give the salespeople all sorts of stuff--t-shirts, software, hardware, and all sorts of non-computer related stuff. They were gifts & contest prizes that I had to pay taxes on. So I sold the stuff I didn't want on eBay.

And promptly got fired for it.

2008-01-30 06:48:45 PM
This is farking bullshiat. It's more than that, it's insane!

If they wanna go for more stupid, how about going after kiddie lemonade stands and fine them $1000.00 per cup?

Sheer stupidity at work!

TerraSin: Correct me if I'm wrong, but isn't Ebay the auctioneer? The seller is simply that, the seller.

Aren't eBay just providing the tools for users to self-control all aspects of how their stuff is sold? Ie, the seller is controlling the Auction?

I'll answer it for you, in another state. State's have no jurisdiction over interstate commerce, this is a federal issue.

You're calling it assnine that she started a business and didn't apply for the proper licensing? You're retarded then.

I don't care if her kid has cancer or not, that doesn't justify her breaking the law.

As a Harrisburg area resident who makes a living as an "auctioneer" on eBay, I'm getting a kick out of...oh, who am I kidding, I'm getting a kick out of not shaving for 2 weeks and wearing my P.J.'s all the live-long day.

Before anyone hates me too much, I am quitting to find a "real" job because total daytime freedom is turning me into a loser. If I spent that time exploring the real world, educating myself with marketable skills, or creating things with artistic value, it would be a different story. As it is my current goal is to create this. (new window)

Plus, I certainly don't want anybody knocking on my door demanding fees or fines. They may see me in aforementioned P.J.'s.
