I think you missed the point. The issue is not whether defensive violence is moral, since almost everyone agrees that it is. The issue is people who regard violence as a positive pleasure rather than a grim necessity. Most gun owners in the US never fire their guns in anger against a human, and most have no desire to do so. Unfortunately there are a few who are just waiting for a legal opportunity.

If they intended to kill you then yes. It doesn't matter that the mechanism wasn't the one they intended, so long as the result of their actions (almost killing you) matched their intent (to kill you).

If not, they don't have the proper mens rea. In some jurisdictions they could be charged with reckless endangerment, though. And if they do kill you, they could be charged with manslaughter.
