You contradicted yourself.

For it to be a Darwin candidate, the kids have to die. In fact, there's no mention of whether these were their only kids. If they have living kids at home then it's ineligible.

Too many people like to throw out references to Darwin without having any clue at all what it actually means. Is this subject just not taught in middle school anymore? Do the people who misuse and abuse it not realize that they themselves would likely make an excellent sacrifice in the name of Darwinism?

In NYS, the answer would be both.

1. The driver is responsible for ensuring that the minors required by law to be belted are belted or they receive the citation. Adults that are required by law to be belted are responsible for themselves and receive the citation directly.

2. The parents are responsible for their minor offspring regardless if where they are. Being in somebody else's vehicle doesn't absolve them of their parental duties.

Well if you were in the car and the biatch driving started going 70 mph on a dirt road what would you do? Now at the very least I would expect a reasonable person to tell their kid to put on their seatbelt. Personally, I would do whatever it took to get the dumb biatch to stop and then I'd get out with my kid. And if alcohol was involved I shouldn't have to say anything here. Well, it was a Bronco. Most typical SUV drivers wouldn't be caught dead in a Bronco and wouldn't ever drive their jacked up minivans offroad. At least these people had the decency to die in a fiery wreck in the mud and away from other vehicles. There probably weren't even any traffic delays other than those which will occur as a result of the funeral processions.

XteacherI'd take a thousand rednecks in Broncos going off in the mud to kill themselves over one soccer mom in an Escalade or Hummer talking on the phone while driving in a snowstorm anywhere near me.

I hear that, and I think you have a point and are onto something here.

Steezy: at most she'll get a year in jail, will get over the death of her kid by the time I'm done posting this, and will soon be free to have more offspring.

You forgot to mention suing the SUV manufacturer, the dump truck driver, every surviving passenger, the families of the dead ones, the two trees, and the gas station where she last filled up.

did you just do a Rotsky or a Tucci there?

Pull a Tucci, heh.... That's what you get for trying to be FP.

In all fairness, Tucci handled it like a man, bowed his/her head in shame, didn't say a word, accepted it, and posted an apology pic to boot.

I find that honorable and admirable, and forgive him/her. Life goes on (I might be able to recommend a new years resolution though).

You can't sue trees. You have to sue the tree-huggers that kept them from being chopped down. Can't hit 'em if they ain't there.

shiat, we had two women stoned silly with a free roaming toddler in the backseat. Of course, crash ensues. Toddler survives, but has serious brain damage. Both women get misdemeanors and NO JAIL TIME.

Sounds like something that would happen in West Virginia, except, it wouldn't be an SUV, it would be a Truck.

In an interesting additional detail, the drivers of the dump truck were the baby daddies:

www.ajc.com/metro/content/metro/stories/2007/12/29/muddeaths_1230.html

Apparently, after helping their wives out of the first ditch they'd run into, the men mired their dump truck in the same ditch. The women, cackling gleefully, offered not to help their mates, and instead sped off at 70 mph, crashing almost immediately into the tree (it couldn't have been immediate, you know, because they need a few seconds to get up to that rate of speed).

Good times. Died doing what they loved.

Benjimin_Dover: davezog: Not to defend this person in any way, but why would she be going to jail for being a passenger in a car accident? Not fastening her child's seatbelt? Is that her fault, or the fault of the driver? Serious question...

In NYS, the answer would be both.

1. The driver is responsible for ensuring that the minors required by law to be belted are belted or they receive the citation. Adults that are required by law to be belted are responsible for themselves and receive the citation directly.

I am wondering if the child perhaps *was* wearing a seat belt, if he got out with just scratches.

From the article: "None of the victims was wearing a seat belt ..."

So the survivors might have been belted in.

And did it have a lift kit on it? This is why you never let a 24 yr old girl drive your mud boggin' rig.

Guffey's four-year-old son, Brody, sustained minor injuries in the Friday night accident and was later released from Sylvan Grove Hospital in nearby Jackson.

Another passenger, Tammy Flick-the mother of Zoe-remains in stable condition at Atlanta Medical Center with a broken leg.

Thanks to the miracles of stem cell research and other advancements in technology Brody and Tammy Flick will be able to make Jethros and Ellie Mays and other "mud-bogging" commandos.

Just stay away from Brody's junk

There was an article on Britney Spears losing her kids. Rotski decided to "correct" a non-existent typo in the headline. About a hundred posts pointing out what a dumbass Rotski is ensued. He handled it way less gracefully than how Tucci did.

So now it's a term for fixing a grammar error that doesn't exist to begin with.

theorellior: Is it typical to go 70 mph while "mud-bogging"? I always thought off-roading was a high-torque, low-speed pursuit. But I drive a hybrid, so what do I know?

I've been mud bogging, but we certainly didn't go anywhere near 70 mph. Of course that was on an ATV & I'm not sure what the top speed on one of those is.

Well, the only surviving passenger, besides the adult woman, is a 4 year old boy. I guess you could try suing him, but I don't know what for.
