This made me angry just watching it. The attitude of the cop involved makes me glad for the 2nd amendment - at this rate, we all might need that someday.

Judge's Ruling: Fire the cop and taser his ass in a jail cell should he give the slightest provocation; give the family some spending cash for their trouble.

I know it's not just Utah, but Lord knows I'll be a lot more wary the next time I'm out that way if this is how these cops are 'trained'...

Check this out...

I used to live on a back country dirt road in NC. Well at that time, my folks were staying with me (hard times for them) & (me too). Well one evening there were two dudes beating the hell outta each other and we called 911 to get the sheriff out there to take control of those folks. Anyhoo, the deputy comes on out there and he briefs us on who's who and what's going on and all, (good to go). Fast forward about 3 days later...

I'm in MY back yard at MY bonfire chillin' drinkin' a beer in a red cup (the party kind of cup). I got the music blazing out of the 15 year old CD player (at the time), everything is going good, (as so I thought)!

Out comes my stepdad, (basically my dad). He had alot of medical issues, (He's on morphine at this time), he's yellin and carrying on and all, well he comes up and knocks the red party cup of beer out of my hand! OH HELL NO!!!! My mother sees him and I going round and round, around the fire, she flips out and yells "somebody call 911". My dumbass stepbrother calls 911 and hangs up! Next thing you know a sheriff comes up and by that time we were done arguing and whatall. The next thing you know the sheriff is asking for our sides of the story and what not. Well, my stepdad is telling his story and he says to the deputy "Jason was getting in my face threating me and telling me he's a Marine and he will kill me". No shiat!! The Sherrif looks at me and says you were a Marine? I said yes sir. He says ahhh, that's cool, I was in the Army. What did you do in the Marines and I tell him, he tells me what he did and whatall in the Army, he just looks at my stepdad and tells him to cool it and it would be best for us to just relax and call it a night. My mother kindly explained how things were with him, about the morphine and his mood swings and all that jazz.

Anyhoo, here's the kicker! He recognized us from earlier in the week in the first 911 call. Hahahaha. There are good cops and there are rotten cops.

Remember this folks... You can take a certain group of people and basically find 10% of folks within that group and find "shiat heads"

Capt.Kirk: No place for speculation, the facts are right there on tape. The man was not a threat. The cop overreacted while power-tripping.

i agree with the second part of your statement in that he overreacted. as to the first part, hindsight is 20-20. an officer in that situation cannot know for sure if the person is going for a weapon or not. 99% of the time, they probably aren't. but that 1% can't be ignored. however, there was an intermediate step that should have been taken, which is the clear threat of force.

After reviewing the video, I have come to this conclusion:

1. The man involved could have signed the ticket and went about his business normally. Instead he started getting offensive.

2. When the cop orders you out of the car, you do not walk around freely as you wish. The cop ordered you out of the car for a reason. If the cop says to put your hands on the vehicle, you do so. You don't walk around pacing going "What is your problem?"

You failed to sign the signature, the cop has the right to arrest you for not doing so.

3. There is the possibility that the use of the taser was not justified, however--we have no real justification for the use of the taser. Most certainly there is only very little agains the taser right now--only a minute amount of deaths in comparison to the amount of times they're probably used. Obviously this guy didn't die, neither did the woman in one of the other videos.


Did the cop use excessive force? Probably. Did the man disobey the cop? Absolutely.

It would be different if the guy had his hands on the car and the cop tased him--but the guy was purposely being confrontational and his actions if I were standing there would be considered defiant and borderline ready to strike--whether by lunging at me, running away, or entering his vehicle.

I support taser use, but this is standard cop abuse, we should be thankful he had a taser instead of clubbing the guy like a seal. Thank god he was white, I don't think I could stand more Al and Jesse. See cops don't hate black people they hate people.

Fair enough. I have to say that blanket statements aside, I still have lost all trust and faith I have in the police. It makes me raging mad that a once great country has become everything it stood against when it was concieved. The citizens who refuse to own their constitutional rights, the cops who abuse their power, and the career politicians who make crap policy are all to blame. I dislike them all, but the cops that are the executors of those bad policies draw the bulk of my ire. That's not to say they are blameless and just doing their jobs. Too many of them couldn't care less about what they are enforcing so long as they can swing their wangs about.

Enough of this though, it's late.

Wow, WAAAY late to the party here, but let me just warn you all that this is par for the course in Central / Southern Utah. I can't reveal too much, but I did work for a law firm that was handling several cases against the UHP. They don't forgive even 1 mph over the limit, and they turn every stop into a full search. And if you're a minority... sheesh. Just drive the limit in Utah. If this video doesn't scare you straight, maybe all the stops NOT caught on video (where the cops got away with worse) should.

Not trying to single you out, but you do realize there are dickheads in every profession. Sooner or later you'll encounter one. I've had more run-ins with good cops than bad ones. And one thing I've noticed with cops(and just about anyone else), you act like a dick, they're gonna act like a dick. Most people that are "harassed" by the police, usually do something to bring it upon themselves.

The best thing to do with the police, whether they're wrong or not, is be courteous and do what they ask of you. If the police are in the wrong, let the courts handle it. Unless police are trying to kill or injure you for no good reason, then do what you have to do.


I had my motorcycle stolen, called the police, said they couldn't come out and would send me a report in the mail.

I took a ride up the street to this long road where people have been known to dump cars, bikes, etc. and what do I see? FOUR cops sitting there with radar guns at the ready and one on the side of the road with a motorist pulled over.

This is the only time I've ever needed a police service and they weren't there for me.

fark em all. This just makes me realize why I hate the Police.

Follow an officers directions. He doesn't know if the guy is goin to his car for a weapon. Pregnant wife or not, he doesn't know if the guy is a drug dealer. Any argument you have with signs being posted, etc. should be taken up in court. Not with a police officer.

The officer is a douche for thinking it necessary for using a taser, but I still say he should have gotten the guy on the ground and cuffed him either way.

Even then, it's a taser you farking panzies. The guy is up and walking around without crying/writhing in pain in less than a minute.

The cop is a moron who was clearly nervous in the situation, which means he probably shouldn't be a cop. But the driver was a douche. I'm glad he got tased. Should tase him again.

He was still 8 or 10 feet from the car door. If the cop thought he was going to go get a weapon, he had time to warn him 3 or 4 more times before hitting him. Also, if you look at the tape, only the tips of 2 fingers are in his pocket, not like he was reaching in to pull out a serious weapon. And the was no bulge like there would be if there was a gun.

Good, experienced cops know when it is a real threat. There were too many subtle clues that he was not. Super-cop was just looking for a fight.

How does one use a taser on a suspect after you engage them physically? He tases the suspect, he tases himself....

If you are blatantly disobeying a very, very, very simple verbal command to "turn around" as you're heading back to your vehicle after being detained, using a taser is completely justified. He didn't know if the guy was going for a gun, a knife, to haul ass, who knew.

He could claim he was getting his rosary and be going for his Glock, the cop doesn't know.

1. Is the driver a resident of the STATE if he is why is he required to sign? THE STUPID COP could have simply stated Utah State Law requires a signature, it is not a admission of guilt.

2. When the COP drew his weapon and pointed at the driver who was not a threat, nor was the person trying to flee, the driver was walking toward the police vehicle, only after the officer pointed his weapon at the driver did the driver react defensively. It appear to be more of a concern for his life.

3. The driver reacted defensively when the STUPID COP drew and pointed his weapon in manor that a person could and would believe their life may be in danger. The driver was not resisting his hands where in his pocket the officer never considered his hands a threat.

4. This Cop Gardner is a danger to the public and should be FIRED immediately.

5. THE STUPID COP did everything possible to escalate the situation. Had the driver responded and shot the officer the driver would be justified as self defense.

6. The bald COP is another idiot who thinks tasering people is a big joke, He needs be sent to counseling and given a written reprimand.

1. I did go to law school; and obviously a better one than you did.

3. Your first cite merely stated the obvious fact that contracts signed under duress are not valid. No shiat, Sherlock. It did not mention anything about qualifying a contract with your signature.
4. Your second cite, from the Texas AG, said that those words MAY invalidate a contract, a far cry from your "it invalidates" claim.
5. Please, go ahead and try it with your next utility bill. Let me know how it works out.

JPenman - You are correct; the signature is just a promise to appear in court if you do not pay the fine to argue the point. It actually says so under the ticket.

I would guess this cop gets a slap on the hand for this, but does not lose his job. He had no idea if the guy was a lunatic once he started acting screwy. Always listen to the cop, no matter how it hurts your ego. You can have your day in court and make a monkey out of him then without getting tased.

Half the time the cop won't even show and it gets dismissed if your lawyer is there...

BlockBug: When the COP drew his weapon and pointed at the driver who was not a threat, nor was the person trying to flee, the driver was walking toward the police vehicle, only after the officer pointed his weapon at the driver did the driver react defensively. It appear to be more of a concern for his life.

He did not react defensively, he reacted contemptuously. I don't think he thought the cop was going to tase him. Hell, he didn't even think that he was going to get a ticket! His behavior was the exact opposite of someone who feared for his life. He sneered at the cop, said "what the heck is wrong with you?" and walked away.

stupid farking asshole had it coming to him.

The side of the road is not the place to argue or discuss about the ticket. That's what your court date is for.

Do what the police officer says, write down everythign you can remember, then if you have problems with it, see your lawyer.
