My wife hit a durnk late one night. His head came through the windshild and broke her dashboard. It was horrable. The dude hopped over a fence and ran right into the road right infront of us. A cop was right behind us and atfirst thought we lost our bumper because he didn't see the drunk either.

I know lots of people wont look both ways when there are stop and go lights. But Police are supposed to be super observant and extremely cautious.. Maybe she just got off duty and turned her super senses off for the night.

I hope the drive has a very good lawyer...

I'm sorry, but DWI by consent is bullshiat. If you don't have a breathalyzer or the training required to administer a field sobriety test, how in the hell are you supposed to know if someone is drunk or not?

If they want to charge her with letting someone without insurance or a license drive her car (and I'm sure it's against the law), fine. But, DWI by consent?? Please...

DWI by Consent.... The chick let a person under the influence with out a DL drive her car. She probably knew that the girl was drinking and also knew she had no license, Because she is the registered owner of the vehicle she is totally responsible for who is driving there for she is at fault. It sounds better than Manslaughter by Consent....

Here is Tennessee's law regarding DUI by consent, for an idea.

Apparently, you can be charged just as though you were operating the vehicle yourself.

SchlingFo. IM not sure where you live, But here they have an absolute sobriety law. If you are under the legal drinking age and you have any alcohol in your blood while you are operating a motor vehicle you are considered under the influence and you are charged, So if that lady had any idea that the girl driving her car was drinking its automatic.....

They do have laws like that here, but a person underage isn't considered intoxicated if they have a drink. It's a separate charge, although I can't remember what it's called exactly.

Would the DWI by consent charge still come about even if the driver was over 21?

Maybe there was something across the street she had to focus on as a cop, but when I cross the street I always keep an eye on oncoming traffic. She didn't even react or attempt to jump out of the way.

On the DWI by consent thing - if I'm drunk and I let someone else drive because I think they're sober, am I still guilty of DWIbC ?

I can't believe some of you are blaming the cop. Even if she didn't eagle-eye the intersection, the biatch ran a red light. The cop had the light with her, and even someone who is super-vigilant probably wouldn't think that some idiot might run the light, even with a pedestrian in the street, and plow into her.

That little drunk is in big trouble.

We also have an absolute sobriety law here--if you're underage and have ANY alcohol in you, you're breaking the law.

There are a plethora of charges that can be brought against this dumbass for letting a person with no license and no insurance drive her car. But, charging her with DWI, even by consent, is ridiculous.

Here's a scenario:

You're at a party, and you're piss-drunk. Your friend offers to take your car and drive you home. You know he's had a few, but you're in no state to determine whether or not he's sober. He gets pulled and gets a DWI on the way home. Are you saying that you'd deserve a DWI by consent??
