Well its not a US vessel its flying under a flag of convenience the port of registry is Nassau in the Bahamas. Which means there screwed. If they actually spent the money on dealing with the issues of flying under the U.S. Flag (Namely the expense of complying with Coast Guard regulations) they would have had some chance of the Spanish not messing with them or at least handling it differently.

The ship may be owned by a "American company", but it's not a US ship. The ship was Bahaman flag. Let the Bahamas bail these guys out with the Spanish. They don't want to fly the American flag, let them figure out why they should have the hard way.

Cool thing I once learned about Sir Francis Drake vs. the Spanish Armada. That battle was really won on land maybe a year before the sea battle, but only Drake knew it. Drake led some shore raids that destroyed depots of repair parts and spare timber, etc. for the Spanish navy. A fleet is only as good as it's logistical chain allows it to be. Without the chance to repair and refit, many of the Spanish ships were in sad shape when they formed up to cross the channel, with rotten wood and canvas. This takes nothing from the seamanship and battle tactics of Drake, only pointing out that here is a lesson that never gets old and should be a staple of war colleges; that you don't just fight an enemy with guns alone, but with strategic thinking.

I'm still surprised that the Spanish pulled this off, because it's rare for a warship to do something like this. But I guess the Spanish really pissy. But I think it's clear that if the ship was actually US-Flag, they wouldn't have pulled this kind of move.
