Mom who sued motel over porn film wins $85,000

A mother who sued an Artesia motel after her two young daughters were exposed to a pornographic film on television was awarded $85,000 by a jury Friday.

In August 2006, Edwina McCombs of Nashville was visiting Southern California with her daughters, who were 8 and 9 at the time.

The family stayed at Value Lodge at 11854 Artesia Blvd. McCombs went to take a bath while the girls were watching a children's TV show. Soon after, the girls somehow changed the channel to a porn film, said Eliot F. Krieger, McCombs' attorney.

"It was unclear how long they were exposed to it, but they knocked on the bathroom door and said, 'Mommy, something's wrong,' " Krieger said.

During the trial, a hotel expert testified that he had never heard of a family-style hotel or motel that did not require adult verification to access pornographic films, Krieger said.

The motel owner, Charles Su, argued that guests were encouraged to tell the front desk to block access to the adult channel, said Max C. Chiang, Su's attorney. "We offered to settle for $50,000 before the case, so it's just $30,000 more. We're OK," Chiang said.

The jury at Superior Court in Norwalk awarded McCombs $65,000 in economic damages, which include medical and legal bills, and $20,000 for emotional distress, Krieger said.

"The jury did the right thing and are sending a message to other hotels," he added.

Having worked in a hotel some years ago, there is a simple request you can make, blocking undesirable content from your account.

Most hotels I've been in if you want to watch movies you just select it on the remote and it tells you it'll be added to your bill.

Back when my son was 17, he went with a neighbor of ours, the neigbor's son (17) & stepson (8) to visit Disneyland, Knotts Berry Farm, etc.. They stayed in a motel in California that had in room, close circuit hard core porn. However they made certain the 8 year old was asleep before they watched said porn. Our neighbor wasn't that worried about his stepson seeing some porn so much as he knew that fire & brimstone would rain down on his head when his stepson's mommy found out her son saw porn. And trust me, the kid would have told her without any encouragement.

bugmenot is great and everything, but I just did a search on google news and found plenty of articles about the same story.

I screw them over as much as possible. I always test to see how old they'll let me get away with being - or occasionally how young. I'm sure there are some 100 year olds surfing the net, but not many - probably fewer 3 year olds.

I remember doing something similar, best thing we got was Queer as Folk (the original UK version).
I watched that with the sound at near minimum freaking out everytime I heard a sound in case one of my parents was about to walk in.
