No kidding. Police have been on the lookout for "some black guy downtown" ever since my friends an I used him to find beer and weed for all those years.

If

The Supreme Court [...] ruled in 2005 that the sentencing guidelines are advisory, not mandatory.
Then WTF was was the rationale when
The 4th U.S. Circuit Court of Appeals in Richmond said judges are not free to impose sentences shorter than the guidelines "based on a disagreement with the sentencing disparity for crack and powder cocaine offenses."

powder cocaine has the inherent punishment of blowing up in your face if you try to smoke it. putting coke dealers in prison would be double jeopardy! case closed.

To play the devil's advocate here, I think that it could be reasonably argued that crack does a better job of ruining people's lives and has a generally larger detrimental effect on the community than ecstasy or maybe even regular cocaine.

Darwin would probably agree, and I think he would find meth to be useful in the same pursuit.

Crack was invented and distributed by the CIA to keep the local police in business, by using poor, uneducated Americans as their foil. This in turn lets news organizations blast us nightly with fear and dread, which also supports the emerging police state.

Federal sentencing guidelines called for a range of 19 years to 22 years in prison

It doesn't say sentencing guidelines for BLACKS, the rules apply to everyone. Maybe they should be concerned with the sentence involved BEFORE dealing drugs, not after.

Congressional opponents of the laws establishing more severe sentencing for crack cocaine than powdered cocaine are racially discriminatory because they hit more directly at the black community, where this form of drug abuse is more commonplace.

WTF? You can't even say that blacks like fried chicken without being called a Nazi and they can say that?

And here I thought penalties were higher for crack because it's a more concentrated and harmful drug.

2007-10-02 09:11:47 AM
What a load of horseshiat. Maybe all of the black drug dealers should wise up and start selling powder with a do-it-yourself crack kit. Or they could just stop selling drugs.

Might as well be written:

Congressional opponents of the laws establishing more severe sentencing for crystal meth than Nitrous Oxide are racially discriminatory because they hit more directly at the black community, where this form of drug abuse is more commonplace.

If we want to base sentences on the amount of harm that the drug is doing and the scope of the problem, I have no problem with that. Crack and meth should get the hardest sentences.

I also must admit that I'm curious as to how the neocons are involved in crack cocaine sentencing guidelines.

2007-10-02 09:15:42 AM
These laws are racist - across the board, for instance, cocaine laws are less strict than crack laws, even though crack IS cocaine. It requires less crack than cocaine to get a felony conviction.

Why is that? Certainly not because lawmakers love cocaine.

It's not, really. There was never really a crack epidemic either. Just propaganda.

So say the numbers, anyhow.

I'm sure they're the most damaging overall in the states at the moment, but my old town has been ravaged by heroin fairly recently and it's not pretty. For a damage per user base I'd agree with you.. just don't go for harsher sentencing for one drug of choice just because it's the only one causing your town problems *right now*.

or because freebased cocaine is somehow different to the powdered stuff?

If alcohol prohibition in the 1920s (by constitutional amendment) had done more damage to the African-American community than to "White America", it would never have been repealed.

War on drugs? More like a gang full-employment act. Legalize it already.

2007-10-02 09:21:17 AM
i know how to end racism... if the crime is committed by a person of color then they only have to serve 50% of the sentence while the whiteys have to serve all of the sentence.

it's only fair.

Ugh. It's still coke, it's just a different delivery method. The effects really aren't all that different from the powder form. Again, massive studies have been done about this. Most people choose to believe the drug czar's take on it for some reason that I'll never understand.

I am usually very liberal on these things and was all set to come into the thread and condemn racism, but we are talking about farking CRACK. I don't care what race you are - get the fark out of my society and go to PMITA for many years. Same goes for the rednecks who cook, use, sell METH. Do not pass go, do not collect 200 bucks.

/Let us review this again - smoking pot, as long as you only wake and bake on weekends = OK. drinking, as long as you don't drive, fight, or have enough to black out/vomit = OK, shrooms/LSD/XTC, as long as its not more than a couple times a year = OK, everything else = NOT OK

So the drug came in like Godzilla and ravaged your town? The drug is causing all of your towns problems? I would have guessed that it was the idiots who were choosing to use the drugs. I had no idea that heroin would crawl into a syringe, wait in the bushes and jump into your unsuspecting arm. Who knew??

One of the supposed reasons this law is "racist" is under federal guidelines possession of 5 grams of crack gets the same mandatory sentence as 500 grams of cocaine. Since most crack offenders are black the law then must be racist. Or so they say.

Under the current sentencing guidelines, it takes 100 times more powder than crack cocaine to trigger the same punishment.

The overwhelming majority of cocaine users in general are white. The overwhelming majority of crack cocaine users are black. The mandatory minimums are racist.

Ahhhh I see the cliches are already flying!

If you want to know all about black cocaine dealing--I would strongly recommend ignoring the hand-wringing white liberal cliches and instead go down to your local bookstore and purchase "Game Over" by Azie Faison. Faison is an infamous Harlem drug kingpin from the 80's and 90's, and this book is all about the drug culture that has exploded in the "inner cities."

Faison is quite clear--cocaine and heroin money absolutely supports large segments of the black community. Getting an education and getting a real job is for chumps. He talks about one guy who was so good at basketball that he beat one of the Lakers one on one and he was offered a contract with the Lakers--but he turned it down because he could make fives times that amount selling heroin. It is that simple.

There are good men in the ghetto who work hard for a living and Faison talks about them. He talks about an old man who owned a restaurant on his block in Harlem. This old guy kept shooing drug dealers away from in front of his business but they kept coming back so eventually he called the police. The dealers took off--but came back a few nights later and shot the old man dead.

You guys want to know about drugs and black males, well read about it from somebody who lived that life. The CIA brings in cocaine? HAH! Read this book--not one white face to be seen! ALL the drug suppliers are black. I realize that white people like to feel like they control everything and everybody, but this is a parallel culture that has ZERO to do with whites. In fact, the only whites ever mentioned are from movies--"Scarface" and "The Godfather" are mentioned as being THE inspiration for early drug runners getting into "the game." Azie and his boys idolized these movies and wanted the easy big money.
