In his report, Benanti faulted State Police for not charging Boston police officer Thomas Griffin, whose vehicle struck and killed Michelle Vibert in her disabled vehicle at 2:30 a.m. on Aug. 12. 2006. Vibert, of Weymouth, was a 29-year-old mother of two.

I think she's cute.

I think cops do this all the time, and that it's absolutely ridiculous. I used to have a friend who's brother was a cop; parties at his house had more drugs than any other parties I'd ever been to at the time, and for some reason they never arrested eachother over a tableful of lines.

Are there shield laws to "protect" asshat cops from civil suits? It's not as satisfying as tossing him in jail, but garnishing a portion of his wages for the rest of his life would be better than nothing.

This retired cop is obviously mistaken. It is a well known fact that all Officers of the Law are perfect examples of humanity. They never abuse their power for personal gain and always, ALWAYS follow the law to the letter. This "retired" cop was obviously tossed off the force for not being a paragon of virtue, and now is exacting his small minded revenge by attempting to smear this innocent Crusader for Justice.

It didn't say in there what he should have been charged with. Just because there was an accident doesn't mean someone committed a crime. I'm sure there will be a civil court case of some kind.

The only part I found suspicious was the dynamic of driving home from a bar and not being breath-tested. I think that is probably HIGHLY unusual, whether you appear drunk or not. I'm no cop, but wouldn't a breath test be just about be S.O.P. under circumstances like these?

I think if you or I had been pulled over we'd have been breathing into a tube pretty darn quick.

Well, aside from the sliminess of this guy getting off without even a breath test, I think there's another important lesson to be taken here:

If your vehicle stalls on the highway or interstate, get the hell away from it, right away. Particularly at night, and especially if the lights don't work.

Cops are highly trained professionals with very specialized skills. They are impervious to the ill effects of alcohol consumption.

After hitting a stationary vehicle on the interstate? I doubt it. I don't think a normal person would have been charged for this, had they not been drunk. Sometimes accidents happen, and no one's expecting anything stationary on the interstate - you'd probably still be found at fault, but probably not grossly negligent enough to be charged with anything.

The only slimy part I see is the lack of a breath test, but that is very slimy.

I've been present at more than one guy-driving-home-from-the-bar accidents where the driver didn't get breath-tested. One of the times we even asked the officer to breath-test him, saying that we smelled alcohol on him before the officer got there. No dice.

So, anecdotally, it's anything but standard procedure to test someone just because they're driving from a bar.

Man, I can't emphasize this enough. My very good friend in college got out of her stalled car on the expressway and tried to look at the engine. As she stepped out of the driver's side she was completely wiped out by an asshat passing on the right at about 100 miles an hour. Hope he got where he was going in time. She's dead.

I remember when I was going through a high school a kid that attended the same school was hit by an off duty cop while skateboarding. The cop blew a 0.12 FOUR hours AFTER the accident. The impact of the hit ripped off the kid's right arm, and sent him flying nearly 20 feet.

The family?
Devistated.
The school?
Devestated.
The cop?
Home free like it never happened... kept his job too.


The Illest part of this story is that the kid worked at the same wendy's my brother worked at... and I was there getting free food from my brother when his shift was up. I was standing there as my brother asked the kid if he wanted a ride home...

He said no, he'd rather skate.

Cops can still get a DWB if they are in the burbs, out of their jurisdiction. They seem to be the only DWIs I can recall of cops.

Would speeding be considered an aggravating factor?

If the speed at time of impact was 62 mph and that was (according to testimony by a passenger) after braking, the original speed was probably considerably higher (although since the car almost certainly has anti-locking brakes, there would be no skid marks to use to calculate by how much).

I live and work in Massachusetts and from my work I can see the dorchester gas tank. I am totally not surprised at this story at all. I drive on that highway all the time and I ALWAYS end up pissed off or scared for my life(or both) at the end of my trip. Literally every other car has someone doing something in the drivers seat other than driving(cellphone, makeup, eating, drinking, etc.) Not to mention that people here dont understand basic road rules (like turn signals). In fact I know this road so well that I can tell you exactly how this went down.


The defendant was driving in the middle lane (mostlikely tailgaiting too.) Defendant wanted to pass other driver. Left lane was full(because people in mass use the left lane for traveling.) So the defendant (without signaling most likely) moved into the right lane to pass the car in the center lane. While being distracted by some other activity(possibly just being drunk) failed to notice the 3500lb, full size, family sedan half in the right lane. Defandant then struck the stationary vehicle and in true Massachusetts fashion blamed it on the other person.

Clarence Boddicker is one of my all time favorite Kurtwood Smith roles - right up there with Red Forman.

The only thing the police are good for is providing paperwork needed to file an insurance claim. If you don't need the paperwork, you're better off calling a hippie like the bumper sticker says.

But seriously, how could he not at least get charged with a DUI (or did he actually claim to have been drinking during the four hours after the accident)?

Actually this is the one piece of the article that I think is true. You obviously dont live in Massachusetts. The average speed on any highway in Mass (especially the one where this occured) is lower than the posted limit. Usually people travel sooo slowly on this highway its not even funny. I almost wouldnt doubt that the estimate of 62 is on the high end.
