So, a burglar can be SHOT DEAD with no charges pressed against the home owner, but if he uses what the court deems "excessive force" he can be sued? That's such BS. I'm all for a law that waives all the burglar's rights once he breaks into another person's home.

In other words, he wouldn't have been sued, he would have been charged with a criminal act if he used "excessive" force. If he would have used a gun on a guy with a knife, it may have been deemed "excessive" if he shot him dead. If he winged him in the leg to disable him, then he would have been fine.

I guess in this case knife = crowbar in the eyes of Canadian Law.

I believe in the concept of "excessive force" after bad guys have been subdued and are about to be placed in custody.

Before that event, I don't believe in any such concept.

There is no law there except one: "Me bad guy, if me weaker and slower than you, me lose you win, if me bigger and stronger and faster than you, me win, you maybe die." Outside of might-makes-right, this is a situation where laws do not apply.

Oh, and the comment about, uh, minimum amount of force necessary is assinine in the extreme.

Anybody got a reading on what the gun-grabbing laws there? Just because it's Canada, all bets are off and nobody can have one? Since I'm sure a .38 would have been a lot handier here in restoring piece than a crowbar.

being a Canadian who is also a qualified rifle safety instructor, I can answer that :) (Plus, I submitted this link in the first place...)

In Canada, we can possess firearms, although transporting them is not as easy as in the US, especially handguns. But within one's home, we are not allowed to store a loaded gun in the drawer next the bed. Firearms are supposed to be stored, unloaded, in a locked container, or with an approved trigger lock in place. Ammunition is supposed to be locked in a separate container.

So, had the hero of our story pulled out a rifle or a handgun, inevitably he would have been questioned as to how, under such stress and time constraint, he managed to unlock the gun, and the ammo, and then shoot the burglar. That would have likely led to charges of unsafe storage of a firearm, and probably also aggravated assault with a weapon or attempted murder/manslaughter charges for shooting the guy.

Fortunately, we do not have crowbar storage laws :) I personally keep a wooden replica katana sword (it's a sparring sword) in my bedroom closet. If any home invader manages to get past my german shepherd, then I would club the bastard into submission with the katana to protect my wife and kid.

Its a good thing when people shoot and kill people breaking into their home. before all the more liberal among us get upset , let me explain.
1. person breaking into hose is removed from the genetic pool bringing ballance back to the process of evolution.
2. tax payers save money on the trial and pound em in the ass prison stay.
3. Knowing you might get your head blown off is a real detterent to outhe would be hose robbers.

Thanks so much. You confirmed my suspicions. If I had a gun stored in such a way, of course, once the occasion arose I'd probably be reaching for a crowbar.

It occurs frequently in the U.S. that a crime in progress is stopped, or prevented, by means of a handgun without any shots being fired and without anyone being hurt. It's not an urban legend, either. Given that, perhaps this burglar would have preferred it that the gun restrictions be relaxed up there, just so he could have kept all that blood in his head instead of messing up their nice rug with it.

Layers of defenses work well, like Dexter_kcd's german shepherd backed up by a katana sword. In my house, my mixed breed dog is backed up by a claw hammer backed up by Mossberg 12 gauge shotgun.

At least, that's what I'd tell the cops, after I'd dropped the hammer to the floor next to the shotgunned perp. Good stagecraft is also a part of home defense...

I've been checking out California firearms laws lately, and, besides making Dianne Feinstein's husband a bunch of money, they do nothing but remove rights and make things much more expensive.

If I remember right from my CCW class (yay AZ), in California they have a 'last-room' law or something, meaning that they must be in the last possible room of the house with no other exit than the one the intruder is coming in before they can fire a gun in self-defense. They want you to run, preferably screaming like a little biatch and wetting yourself (it actually says that in the bill).

Simple solution. Have something with two lockable drawers near your bed. Gun in one, ammo in the other. Key close at hand, preferrably already in the lock and ready to be turned. If they have to be in seperate physical objects, not just drawers, have two side-by-side. True, it's not as good as having it at the ready, but if you can load the ammo quickly (get a clip-based handgun rather than a wheelgun) and hopefully you'll be in compliance with the letter of the law.

Come on, guys. There's a much easier solution to this problem. Just kill him outright, dump the body in a park somewhere, and pick up some OxyClean on the way home, for the rug.

The laws cater to criminals, and the police are there to protect them. Sad state of affairs, but when laws are made by the folks who practice it, what can you expect?

if this was in america, the burglar would have sued for millions, someone would have called the guy defending his house a racist, an anti-crowbar lobby group would protest outside of his home and the attacker would be on Montel.
