This inmate should be suing the initial defense lawyer for malpractice. How can that possibly be murder and alife sentence?

As far as inmates in general, you can't deny inmates medical treatment, but you can't give them a better level of care than law-abiding citizens either. Maybe a good measure would be what the state employees' health plan covers.

In this particular case, let the inmate have the operation if he can come up with the money through donations.

Why haven't we outlawed this behaviour yet? These people are mentally ill, and shouldn't be free to roam the streets. I'm not a close minded person either. Do whatever you want from the privacy of a jail cell, but it shouldn't be out where I have to see it.

Prisoners have access to a legal library while in prison.

They file lawsuits between the times of being raped (or raping somebody) or shived (or shiving somebody).

Filing lawsuits against the prison is one of the forms of recreation, along with digging tunnels, getting tattoed, and trying to stick it to the guards without getting your ass beat.

Every once in a while, it's nice knowing SCOTUS is so conservative these days. Too bad by the time it gets that far, the state will have spent so much on the case they could have changed all the transgender inmates in the system back and forth several times.

I wouldn't jump to that so quickly. There has been legislation pending since like 2005 for other prisoners to do exactly that.

Yep, pretty much, and they'll name anyone and everyone, from the COs up to the governor, in their suits. Prisoners are also allowed to file lawsuits in forma pauperis, meaning they don't have to pay the filing fee if they can show that they don't have the money (which is a good thing really, because if your civil rights are legitimately being trampled you shouldn't have to pay to get justice). But obviously this leads to widespread abuse. So now there's the Prisoner Litigation Reform Act which allows judges to throw out frivolous lawsuits and count them as a "strike" against the inmate. Three strikes, and you're out. No more in forma pauperis lawsuits.

I used to work for the Illinois DOC and I set up the initial strike-tracking system. The AG's office loved me because I would check their upcoming inmate litigants against my database, and the Assistant AGs could then go to the judge with a list of past strikes and have the new suit dismissed before it even got started.

Of course the prisoners were still free to file suit with their own money, but......well that's no fun, is it?

I have no problems at all with transsexuality, none whatsoever. I'd be happy to hear that the state was providing coverage for these procedures to its employees -- that would be great.

But seriously, giving murderers operations that most commercial insurance packages don't cover? No farking way.

I'm with SusanIvanova, who apparently has some sort of compassion and understanding for people who happen to be different from her.

I'd agree with giving hormones to TS inmates in general, and always if they came into prison already on them. But as long as I'd have to pay out-of-pocket for surgery, i damned well don't want some farkin murderer getting it for free. Prison sucks. Deal with it.

And insurance companies are the asshats-extraordinare for not covering something that is NOT an elective surgery. If I was blind, but could have a surgery to be able to see, would they consider that elective? Blind people can do just fine as they are, hell, they get dogs and books with dots, right? It's not like they need to see to live, right?

Not all TS people feel the need for surgery, some just take hormones. Some are the opposite. But they do it because they HAVE TO, not because it sounds interesting, or a great way to blow thousands of *their own* dollars. It's not as simple as so many of you like to think.

Anybody who has a problem with TS people ought to try to imagine what it's like to be in our situation. It's really funny unless you have to live it.
