Good thing that Judge Asshat wasn't around when I was in high school in the late '60s. I'd still be in jail today instead of chasing these damn kids off my lawn.

Wow. Sending teenagers to prison for having sex with other teenagers.

While we're at it, why don't we throw all the unmarried couples in jail for living in sin as well. While they're in there, give them a bible to read.

For crying out loud, people. Everyone was a teenager once. Everyone has made mistakes. You don't automatically become an adult because you turn 18 or 21 or any age. I know some people who are in their 30's that need to go back to kindergarten.

Raise your hand if you had sex as a teenager. Now go turn yourself in.

/sorry, needed to rant for a minute

Smellvin: Whoever was in that jury had obviously never heard the term "jury nullification."

And the judge never heard of "judicial review." But most judges take the stance that they just uphold the law, whether or not that law is just, when the constitution gives them the power to interpret and apply the law as they see fit.

Some judges even go so far as to tell the jury, "You are only here to determine if they are guilty of breaking the law, no matter if that law is wrong or not."

This is just sad.

You're talking about a high school senior with a high school sophomore.

It's not like he was getting head from an 8th grader.

Remember kids, if you have sex before you turn 18, then you support COMMUNISM TERRORISM and are UNAMERICAN!!! So unless you hate FREEDOM, do not act on those urges you may have because until you become an adult, because they are EVIL!!!

This friendly reminder is brought to you by the Republican Party and the Bush Administration.

The judge called the girls "these young ladies" and referred to their parents 'crying out for help'. Give me a freaking break. They were acting like little hos at a party and now some horny teen's life is being ruined. He has already been in jail for two years. That is ridiculous.
If I had been one of those hos (excuse me, "young ladies") I would have never agreed to press charges. I would've faced my parents as the consensual "ho" that I had acted like at the party.
Responsibility for one's self CAN (and SHOULD) be learned BEFORE the 'magic' age of 18.

I bet if he were a white middle class american this would not have happened. Here in TO we had two 'upper class' teens street racing who ran into and killed a cabbie...all they got was 2 years house arrest and 4 years of no licence. Oh, and 14 year olds can have sex here...

mama's_tasty_foods: What a novel concept: apparently the smart thing for a lawyer to do, when his client is accused of a serious crime is SUBPOENA THE VICTIM TO COURT to testify against him, and thereby give evidence to incriminate him.

The "victim" says it was consensual.

follow that thought--- consent is not a defense to, nor is lack of consent an element of, the oral-sex charge.
http://www.state.ga.us/cgi-bin/pub/ocode/ocgsearch?docname=OCode/G/16/6/4

so sending a subpoena to the 15-year-old to have her testify, would do nothing but confirm his guilt. Therefore, this particular tactic being pursued by these dickhead attys he has now, is absurd.

Why didn't that law commute all sentences of people currently on trial for or serving time for breaking this now non-law?

If you're going to name a law after some guy who got screwed by an antiquated and marginally constitutional law, then why not unscrew him while fixing the law?

Georgia's constitution prohibits retroactive laws, so if they had passed such a law, it would have been in violation of the state constitution. It would take an amendment of the state constitution, plus a new law, to reduce Wilson's sentence in this manner.

I was 19 when my 15 y.o. gf told me to come in her room.
SHe was all nekkid on th ebed and said I'm ready for this.
I said, you may be, but I'm not.
I was still a virgin and was saving my self for her.
Her at a legal age.
She took it well enough and we did it when she was 19 at college.
We would still be good friends if she hadn't married an asshole who is jealous about me popping her cherry.
He married her when she was 35. Honestly who would marry a 35 year old virgin?

Right here: http://www.cbc.ca/canada/toronto/story/2007/05/29/cab-driver-case.html

Judging from your posts, you'd support a law that criminalized breathing, as long as it was properly legislated. No consideration for the spirit of the law, no common sense, just an obstinate desire to follow process.

Are you an administrator of some sort, perhaps middle management?

2007-06-06 11:33:34 PM
The ironic thing about all this is that much of the thinking behind these laws (at least in Western societies where Christianity is the main background religion) comes from the "moral teachings" in the Bible.

In those days, however, most people were married off pretty much as soon as they hit puberty, with girls being married off even younger than that. Its no accident that Bar/Bat Mitzvah are at ages 13/12.

Moronic. Have to GBTW so not enough time to write up a long rant, but suffice to say, anybody who claims that adolescents who are SEVERAL GODDAMN YEARS into their sexually awakened stage of life are actually "children who have been sexually abused" is being massively intellectually dishonest, at best.

Just because the law says something, doesn't mean we have to enforce what it says in every case.

Silly law or not, it's a law. If the law says something, you know damn well it better be enforced. Too often in this country, we see laws either with lax enforcement or no enforcement at all. If the law calls for 10 years and a lifetime on the sex offender list for the offense, then that is too bad. I don't care if the provision has changed; he committed an act that at the time of occurrence was a felony. Thus, he is a felon by definition. Period. I have no sympathy for this person; the legal system is doing exactly what it is supposed to: follow and enforce the law. Live and learn from it, people. This guy obviously didn't. Do I think he should be a sex offender for life? Absolutely. He was accused and convicted of aggravated sexual molestation, a felony. That alone is grounds for prison and sex offender registry.

I don't live in GA, but the law is the law. He deserves the maximum punishment for his stupidity. I cannot possibly be sympathetic towards a person who does something stupid, and that something stupid happens to be a felony with sex offender registry required. Ignorance of a law does not absolve one from the punishments or lessen the severity of said punishments.

Bottom line: The guy (17 at the time) performed oral sex on a 15-year old in GA in 2003. According to state law, this is a felony which carries a sentence of 10 years and registry on the sex offender list. He was tried, convicted, and given the maximum sentence. What is the problem here? Looks as though the legal system did its job to me.

char_boy Beat me to it. Dickens said it.
Whatever.

The law IS an ass if a 17-year-old faces ten years in jail and sex offender status for a consensual BJ by a 15-year-old who has testified in his defense. It may have been posted before, and if so I apologize, but can the Nation of Fark email this DA and tell him this is wrong?

Who cares if he was an honor student (Tom Wolfe, anyone)? He was a horny 17-year-old, she was a horny 15-year-old - no harm done here, well, at least till they all find they have herpes.

I don't need to see the video if the 15-year-old says she was cool with it. It is totally normal teenage behavior and it is happening in your white neighborhoods, and I'm talking to you, Mr. Georgia DA.

This is the definition of travesty.

And the judge never heard of "judicial review." But most judges take the stance that they just uphold the law, whether or not that law is just, when the constitution gives them the power to interpret and apply the law as they see fit.

The constitution doesn't say anything about judicial review. The judicial branch assumed that power in Marbury v. Madison.

Some judges even go so far as to tell the jury, "You are only here to determine if they are guilty of breaking the law, no matter if that law is wrong or not."

Considering the results of the Milgram experiment, jury instruction like that is morally reprehensible. People turn into monsters as soon as some authority figure frees them of personal responsibility.

Hopefully cases like this will draw attention to nullification. While nullification is usually upheld, it's always been controversial in modern times. Frankly, I don't even care whether it's legal under the current law. Juries have the responsibility to nullify in cases like this if they can get away with it, and they always will get away with nullifying unless double jeopardy protection gets amended away or juries have to justify their verdicts.

You know, I love this country. I HATE the farking government, but I love the country and I dont want to live anywhere else. However, after reading in one day that a woman was jailed for having her grass too long and now a 17 year old was given TEN farkING YEARS for getting a BJ from a 15 year old, I am considering leaving. I cant beleive what a sad, pathetic nation we have become. Doesnt anyone see that the government is literally trying to regulate and control every aspect of your life, with dire consequences if you step out of line? Either the American people need to step up and give the government an adjustment by force if necessary, or Im going to sadly watch my countrymen get trapped in an Orwellian nightmare.

Come to Canada... we need more people like you.

If you have a post-secondary degree or can find a company that'll sponsor you, it's really easy.

Great beer, better government, fewer military adventures, no terrorism, hawt girls, great education system, national health care, two languages (if you're bored), and lots of interesting diversity to explore.

Oh btw, it's illegal to prosecute teens for having consentual sex here, except in very rare circumstances. Our AoC is 14 so our young people don't have to worry as much about their lives being ruined by religious nutbugs.

Can't you guys figure out a way to switch places with Mexico? I'll be lead American wetback.

Meanwhile, in "tough on crime" America, the The various folks that raped one girlfriend, molested another, broke into my house and car more than once, murdered my niece and nephew's father, etc. have never been looked for, charged or convicted.

But we can blow jeebus knows how much money viciously prosecuting victimless morality "crimes" even though all victims agree everything was fine and dandy and consensual then and now.

It's a good thing we can only show graphic violence here on TV, and not boobies. Otherwise we'd have to lock up all harmless people in jail, and the only folks left in society would be thieves and murderous violent criminals whose crimes are ignored.

Sometimes I'm confident that is already becoming the case in the USA.

2007-06-07 06:46:50 AM
So they made a video tape of this? Any chance the prosecution has this tape? I'm sure in some form or fashion that tape qualifies as child porn...

I still want one of these cases to make national news, where two 14 year olds are both charged and locked up as sex offenders. Not because I think it should be going on, but because the laws are quite stupid, particularly with the fact that people are having sex at a younger and younger age. National outcry over this issue should happen.

Oh, and here's a thought about the tape:

without it showing that the first sex act was consensual, would he have been busted for raping the 17-year-old who had a bad case of the "oops, I changed my mind so it's rape?"

Keep up. The black guy got sucked off by a 15 year old, then had sex with a 17-year-old. 17-year-old cried rape, but he was acquitted of the rape charge since the tape showed it could have been consensual (she wasn't complaining, and seemed conscious enough to do so).

The 15-year-old had no complaints, but she doesn't get an opinion, so he's getting shafted for getting sucked off - particularly badly since for some reason a blowjob is 100x worse than intercourse in their state.

I had PARENTS who told me that sex before you're ready (much less when the guy is ready) will be terrible. I let the guys "do" other chicks before I let them touch me. Yes, it gave me the reputation of 'tease' but I didn't care. I'm nothing to be 'practiced' on. Then again, I've always had a healthy self-esteem. (Which is most likely why the chick is claiming consentual sex.)

That said, I was 18 when I lost my virginity and he was older.

Your opinions on the matter are invalid until you can come up with an alternate policy.

Is a 18 year old having sex with a 13 year old ok with you also?
