Wow. Remind me again why I don't eat at Subway. That is totally asinine. Those drinks cost them maybe 32¢, plus the cup, which she was allowed to use anyway since she was working. To get the police involved is ludicrous.

Most places won't let you give your friends free stuff cause it can be abused too easily. However, a reasonable business would warn her and make her pay for free drinks, rather than fire her and have to train a new worker (which costs them WAY more than two sodas do), and they sure as hell wouldn't get the police involved.

This is ridiculous! She's allowed free soda and water at work so I don't see how they would consider this theft. If they are going to get so bent out of shape over a cup of soda, just make the employee pay for it. Don't involve the police or fire her.

32 cents? Not hardly. The most expensive part of a soft drink is the cup, which is generally on the order of 5 cents or so. The actual liquid costs next to nothing. When you have a contract with a single supplier (as all food joints do) and buy large quantities of syrup it is damn cheap, and it requires but a few drops per cup of soda.

There's a reason why places offer free refills: You can't drink enough to cut in to the profits of it. Soda is where the money is made in the food biz.

I was thinking this was much more likely, as I actually worked for Subway and made myself free sandwiches every day (quadruple meat).

Then again, I also allowed them to save a lot of money by actually occasionally running the entire restaurant by myself, even during lunch rush, and still getting everyone served within a reasonable amount of time. of course, it stressed me out, but hey, I needed a job and free subs are delicious.

/woulda been a manager, but I told 'em beforehand I was only gonna work there for a few months while I was in the delayed entry program before going active duty military

I actually like their food; you can get anything put into salad form. Granted they use iceberg lettuce, but it's still better than white bread.

Nah. I've seen people terminated for a variety of reasons, without any documentation or warning at all.

I used to give free drinks to people who came into the restaurant I used to work at all the time. If all they wanted was a coke- I was happy to provide.

This exact same situation, minus the cops, happened to a girl I worked with at a movie theatre.

It's an easy to abuse policy and definitely within the employer's rights to fire over. However, the cops? Not so much.

I had a friend who was shift manager at a Subway back in college. We had to have stolen about a grand worth of crap from there. Free sodas were the most common, but also free chips, free extra meat (we'd actually take craploads of ham and turkey and cheese back to the dorms rather than go shopping), etc. He'd also ring up a footlong sub as a small round cheese ($8 sub for $1.09) for me all the time. Hell, sometimes he'd do that for customers and pocket the difference. He never once got caught. He even taught the store manager the trick. This is pretty nuts, and there's got to be more to this story than just a couple of stolen sodas.

I can't eat Subway or Blimpie any more. Jersey Mike's, now there's a sub. Quiznos, Firehouse, Philly and the regional sub shops have their moments but Jersey is on a whole other level.

Wow. This is just bizarre. Especially considering the shiat that went down at the Subway stores my friends work at.

My buddy Geoff has the dubious honour of being the reason why they finally installed security cameras. Did the double meat-double bacon-double cheese (plus charge it as a vegetarian) routine a few too many times. Amusingly - at the time, at least, I don't know if it's still the case - the only food item that Subway franchisees actively keep stock records on is bread. Which is why the scheme (along with the distribution of ridiculous numbers of Subway stamps) worked so brilliantly.

Charges are valid but entirely overkill. As a result they'll be dropped.
The firing will stand. A lawsuit will occur, but she'll lose. And tomorrow we'll have some sort of other mundane drama that's the most important thing that ever happened to the people.

About 20 or 25 years ago some lady was arrested at a Burger King for using the restroom without buying food. Seems she needed to go the bathroom urgently before ordering her meal. Busted by some douchebag.

Thinking he was speaking off the record, a BK spokesman said, "We made a GD stupid mistake and we're sorry."

Did the Subway store owner come out with any apology afterward? Probably too late now since there's a lawyer involved.

Actually, the only reason for documentation etc in an at-will state is to avoid having to pay higher unemployment rates. A person terminated for cause doesn't qualify for unemployment. A person terminated "at-will" does. I have dealt with both situations. The at-will was just a matter of convenience for the employee and the company both.

I was nuts for Quizno's when I first had it years ago, but they've gone way downhill. They seem to think they can make up for cheaper ingredients with an ass-ton of spices, which sucks and is why they smell like freakin' Indian restaurants.

A similar thing happened to me when I worked at the snack bar of a major discount retailer (the one that starts with K, not Wal).

I grabbed a cup of ice and was eating it and the security cameras caught me. I got a written warning and a private meeting with two managers who told me that they considered my eating ice theft. Strangely, they didn't say a thing when I showed up to work at 7am on New Years Day still drunk from being out until 4.

From then on, whenever anyone asked what I recommended, I suggested they go next door to Wendy's. I only lasted a few more weeks at that job, as I recall. Surprisingly, it was I who ended the professional relationship.

That job sucked so hard, I still have a hickey from it. That said, I did get to bang one of the cashiers that worked there, so it wasn't a complete waste of time, I suppose.

Theft is Theft no matter how small it is. if the company says you can't share you can't share. Geez folks they own the company and it is their rules you agree to abide by when you are hired.

Now I agree if it was a sip who cares and maybe it was the opening they needed to fire a lousy employee.

You are never required to give warnings for theft.
