The soda was free to people that are working at the location. The soda is not free to friends of people working at that location.

Uh, no. She has Asperger's. That is high level autism. Thus basically, she can function normally. Many people have Asperger's and lead full lives. No one is doubting that people with Autism can function normally, and this hapless Subway worker is an example (being employed and having at least one friend). What DonnieFarko meant was that people with Asperger are not as attuned to the emotions and feelings of others. We can even see the employee's doubt in this quote in the article "I shared my drink with my friend. I was only trying to comfort her. Isn't it what most people would do? I mean, I wasn't trying to do anything wrong. I did what I thought any person would do in the situation." See?

From wikipedia: People with AS lack the natural ability to see the subtexts of social interaction, and may lack the ability to communicate their own emotional state, resulting in well-meaning remarks that may offend, or finding it hard to know what is "acceptable".

So, DonnieFarko's observation was kind of sharp in all this.

I agree with those who say that they were either trying to get her to quit or trying to fire her. I'll probably sound insensitive here--but hey this is Fark it's what we do--she was probably annoying as all get out to work with. Where I work there's a guy who acts *just* and I mean *just* like someone with all the symptoms of somebody with AS. He's rude, irritating and irresponsible. We call him "robot" when he's not around. But, even when somebody gets fed up with him and says something rude to him it doesn't even faze him.

Subway is a rip anyway. Rather go to a local deli like Mama's in Queens, NY or a 24 hour bagel place. For a buck or two more than Subway you get actual meat between the bread of your sammich.

As much as I think calling the cops was overkill, Subway was well within their right to fire her, and if I was in their situation, I'd fire her as well.

Yes, employees at most fast-food joints are permitted a small amount of free food or drink. But that right amost always comes with the very clear stipulation that its only to be consumed by the employee and not handed off to friends.

Refilling your drink and giving it to a buddy isn't covered by the self-use policy most chains have. So what else is it but theft? Also, the whole "I was consoling my poor friend!" without mentioning WHAT you were consoling her about sounds very suspect... i.e. something to cover up that you were socializing on the job, while scoring a few sympathy points as well.

Ever notice how Subway's commercials are all about "less fat than McDonald's" etc? Well they never talk about that bag of chips that they serve with their sandwich ... many of them have at least 5 or 6 grams of fat.

It's free because she's an employee. The drink is not free to non-employees. Therefore, by sharing the drink, she's losing Subway the sale of a drink, which could be construed as stealing.

Given, I'd just dock her pay 2x the drink value and move on.

Not sure if you're from NZ, but the subway in Ponsonby, Auckland is run by an utter coont. I refuse to go back there after how I saw her treating her staff.

Sandwich makers (except for Arther Dent) are unskilled minimum wage labor but they deserve to be treated with at least some respect.

The manager in this case is either a total douchebag or there is more to the story. Or maybe both.

If I can prove that someone stole $4 from me can I call the cops and have them arrested? That doesn't seem right.

Admittedly, in the retail industry I have several times fired people for minor infractions because their overall attitudes were not good for the job. You can't just fire someone for having a 'tude, but if they don't stick to the dresscode or show up 1 minute late -- that can be a firin.'


I have never, however, called the cops on one of these people, it's enough to have them gone. Can't imagine why anyone would.

As far as the worth of the sodas, I work at a Culver's restaurant, and out of curiosity while filling out part of our weekly supply order I calculated the cost of a medium 16 ounce soda in terms of the Syrup, Water, Cup, Lid, Straw. I have absolutely no idea what the C02 costs us, as I have no part in filling the tanks.

It came out to around 10 cents per medium cup of Pepsi. Most of it from the cost of the cup, then the syrup.

Not sure how that translates into this, but I found it amusing that we can charge $1.49 for a $0.10 product (obviously excluding the cost of the machine, C02, and associated labor costs).

This is a lesson to us all. Next time you're angry enough at an employee to fire him or her, stop first. Ask yourself what kind of tag your story would receive at Fark. If you'd get the "hero" tag, go for it. On the other hand, if your story would likely net you an "asinine" or "dumbass" tag, you might want to count to ten and reconsider.

It's actually pretty difficult to fire someone in NZ. You generally have to go through a long-winded process of warnings, 2nd chances, etc... unless it's something major like theft. Presumably they wanted her out of there for some reason, and perhaps they got the Police involved to formalise the theft charge, thereby easing the firing process should there be any hassles (which there obviously will be).

Not that I think it was a reasonable course of action, but it might not be the pure ass-hattery it first appears to be.

No no, you're all missing the point. It was her soda. It was free for her consumption, and once it was in her cup it was, from Subway's point of view, consumed. She could get a big cupfull of soda every day and pour it down the drain if she wanted to, and it'd still cost less than the people actually giving free soda to customers.

That's like giving someone a free meal and demanding they wear diapers and hang around so none of the food actually leaves your house.

One time I worked at this gas station with a take out pizza place. My manager had to fire this 40 your old fat guy hired to make pizzas. She told him that is was because a lot of people had complained about him for various reasons. The real reason was that he stank incredibly bad. His hygiene was atrocious. You could actually track him around the store by his scent.

I think most of the people who say they would fire her have no management experience. I don't know the entire story in this situation but in general training a new employee takes to much effort to justify the firing. It does not make business sense to fire someone for something like this when it is possible to remedy the situation with a warning.

I got fired from SubWay for having a sandwich and not paying for it. I got back from winter break and didn't have any hours. Turns out my "manager," a kid with a napoleon complex, ratted me out. While its true it wasn't my shift so I shouldn't have taken free food.

It was also only 40 minutes before they closed for 2 weeks while remodeling so all their food was thrown out anyway. They said "they couldn't trust me anymore." Which is almost verbatim what they told that girl, must be in the subway manager handbook.

I got a job across the street the next day, never looked back. The same "manager" also was fired within the next week for being a prick and then all the core staff turned over when the owner's brother in law took over the store, since he couldn't get a job on his own. The people running most places like that don't necessarily have the best judgment.

Constructive dismissal is indeed pure asshattery. If your guesses are correct, the subway owners need to be pinned to the wall. This is not how the law here allows employers to behave.

Thanks a whole bunch there "former" franchise owner. We here at corporate take huge amounts of time and money to build a family friendly aura over our stores, get people everywhere to think about eating a delicious Subway sandwich in a clean, safe, well maintained environment, and you screw over 10 years of good advertising with the firing of one employee over a cup of soda. Thanks a friggin bunch.
I'm personally sending Jared to your store to yank your franchise. There's a clause in there to protect us from the likes of you, assclown. Remember how much this actually cost you when you tell the bank you can't make the mortgage payment on the start-up loan they gave you for the franchise.

Culver's? Neat! It's the only decent fast food place in town. Mr Theologian and I go there whenever we can. The salads are not wilted and the menu has a wide variety.

10 cents a cup...that figures. That's why I get a small drink and get all the refills I can handle.

Which brings me to this: Those in California: Do you still have the AM/PM "Thirsty-Two" drinks? I would buy a refillable cup and get 49 cent refills. Good times!

Yes, yes, we know it's a franchise. And not in America..

But Subway corporate better say or do something or else this will mutate into a urban myth, the store transposed to Kansas, and a cup of water.
You know how these tubes work.

That said, I haven't gone to Snubway evar since they dropped the free sub coupons. Okay, the stamps were abused, but..
There are at least a dozen ways to a system that wouldn't be subject to fraud, but they just dropped the program entirely (at least here, your locale may differ).. so I dropped my repeat customering. Good job there, folks..

GammonB, your entire point has rebelled on you. Since, yes, every Subways is run independantly as a franchise, is it unreasonable to think that maybe this one has a handbook? Since they basically make their own rules, no? Not to mention it isn't even an American Subways!
