Despite her being a stupid idiot, she should still have had the common sense not to jump onto a moving object, let alone a moving train. Since she obviously doesn't, they need to check her into a group home, since she cannot account for her actions. If she wants to argue that she knew what she was doing when she walked in, then she must give back the money. Otherwise she must be under constant surveillance until she is deemed able to supervise herself safely. And of course, she should pay for this service.

I fail to see, also, how because of her own fault, her claim is halved 50%. If she sues for 1 million, she should be -charged- 1 million for it being 50% her fault.

Some of you may say that'd be 100%, but you fail to realize that this 50% is being taken out of what she is being awarded. Hence, she's not "losing" anything by her claim being halved to 50% of what she sued for.

I mean, what if she had sued for $5 million. Would they be like, "Lol, well, I guess they should have patched that fence, so it's their fault... but you're a dumbass, so it's 50% your fault too. Let's see, 5 million, okay, you get 2.5 million."

You should quickly learn that court rooms and juries are no place for logic. What he should have done was rule that the train company had no reason to protect people from being that much of an idiot and ruled she pay for court fees. Dumb luck? I guess the idea is to punish negligence. Rewards go to the victim of such negligence. Of course in this case victim was a party to the accident, but it could have been one of the children, especially if the line is running through residential ares (though to callous Farker it wouldn't have made a difference). Of course if the locals are cutting the fence the railway is pretty much helpless and they propably tried to use that as an argument. Of course the problem with state owned entities being sued for damages is, whether they will really be accountable.
