I fully support the right to free speech. That being said having served in the military and lost 4 friends now so far...
I wouldn't hesitate remove him from the site of any funeral. He has the right to free speech I have the right to serve a prison sentence for maiming him.
How those patriot guard members don't just kill him amazes me... And for everyone who gets pissed for someone threatening him... Let him protest your friends or families funeral. He and his ilk can diaf.

If you choose to look down on Christianity, please do not have your reason be Fred Phelps because he is absolutely not anything that is Christianity. True Christians abhor what Fred Phelps does.

Swap "Fred Phelps" with "anyone caught boinking little boys" and you see why theres a whole lot more animosity towards christians.

I just think that this type of activity is dangerous. I'm just waiting for that Marine that has spent three or four tours in Iraq and is not quite right anymore, to go psycho and kill a few protestors. That will be the day when this noise stops.

I get the free speech and all (I consider myself a Constitutionalist first), and maybe we can't kill the guy outright. However, I'm really puzzled at the logic that gets this whistledick from gay people to dead soldiers. I don't think that there is enough mind-altering substance on the planet to make any rational mind connect the two items.

So he should shut his fat ass up and go home to his sheep.

As a citizen of these United States, I support free speech, Constitution, etc, and I believe that Phelps and his ilk deserve every legal protection they have. It is their right and it is what this country stands for, however much so many want to forget it these days.

As a human being, I would buy several cases of beer for the party (or parties) who wiped Phelps and everyone related to him off the planet. We can exclude his estranged children who were lucky enough to avoid the brain washing and got out of his cult compound. What these people do and represent is sick to me, and should be to any decent moral person- not just the hate the encourage but the deliberate manipulation of other people's conscience to incite them to violence.

Incidents do not occur in a vacuum.

He's one of those people who just goes through life screaming for somebody to come kill him.

Phelps very well might not have made any logical connection here. Heck, underneath it all, he might be an atheist, a closet homosexual, and a military supporter. He's just running around trying to get somebody to take a swing at him, so he or his family can sue them (should be no shock that a good block of his "church" are lawyers). If the war ends tomorrow, he'll be throwing himself in front of cars by Tuesday.

This is also why civil disruption is a better response than actually obliging his request for violence. Bikers, counter-protests, really loud car stereos, funny pictures like the "homosex is great" picture farther up in the thread, and other forms of humiliation that don't require physical contact, thus minimizing potential legal liability.

Action Replay Nick is right to some extent. Giving him the attention is just feeding him. But I feel this has gone beyond simply the attention. This douchebag, I feel, actually believe that God is punishing America for tolerating homosexuals.

I think that almost everyone, in the back of their heads, has that little feeling that "you know, freedom of speech is awesome, but if I could take away JUST ONE persons right to free speech, it'd be this guy". I am with that "almost everyone". I have never despised the actions of one group of people since birth more than these people. The sheer arrogance and ignorance that motivates their actions is enough to sheep an entire congregation, as seen by his followers. It sickens me to believe that this man could twist the Lord's words in such an ignorant way and still make people believe him. I can't wait until God himself smites this asshole and sends him to the deepest pit of hell.

Although the kentucky law was overturned this law was okay because it was more narrowly tailored. I really don't have the time to shift through westlaw for you, but the action of protesting at a furneral can be regulated as long as the regulation isn't too broad.

I think the best course is to ignore loonies like this as much as possible, with the necessary local law enforcement making sure that the mourners' involvement with them is minimized. I had almost forgotten about Phelps until this link popped up.

Reminds me of that antiwar protester whose son died in Iraq, who set up camp outside Bush's ranch for weeks and weeks. Now what was her name???

These...people...have been discussed on Fark ad naseum. I've come to the conclusion, based on much of the provided history of Phelps, that this is just yet another money-making scheme, whereas they sue anyone 'violating' their constitutional rights. They don't believe this shiat...they do it because they know what a hot button issue it is and how likely a family member or service member will punch one of them. Unlike cockroaches (will the filter let me slip in my 'cock'?), these cats seek out the light.

Avoid them and ignore them. Make 'em waste their money for nothing. Afterall, all but one of his children work for him as lawyers.

People die for the right to speak freely. They die for the love of the USA and the Bill of Rights. But the right to speak freely just guarantees that the government can't infringe upon Phelps's liberty to yell a bunch of shiat at mourners. People didn't die to defend Phelps from citizens acting against Phelps. Every American has the priveledge to act freely against idiots like this guy.
I am just hoping that Phelps will go away in a conflation of the first and second amendments.
It seems that while Federal forces shouldn't infringe upon his right to protest, a well regulated militia might just be able to take care of him.

The Judge said that the state has "strong arguments." Hence the reason why I put the phrase in quotes. One of the issues, that both sides addressed was whether this was considered "fightng words," which falls under "low value speech" doctrine. This type of speech -which includes hate speech- dosen't receive the same amount of protections as other types of speech. It dosen't contribute to the market place of ideas, so it has a lower level of scrutiny.
