If this is the case I read, the girl tried to claim her right to privacy included the right to take the pictures and the appeals court said the law is allowed to protect teens from their own bad judgment and considering the pictures made their way to her boyfriend's cell phone they weren't all that private. She (i.e. her lawyer) also argued unsuccessfully that her boyfriend was older so it was his fault and not hers.

I hope neither of them ever wanted to work in education, because the mandatory background checks will rule out their ever becoming licensed teachers, daycare workers, or even to work with a subcontractor who works on a school.

Here's a hypothetical.

A teen boy and girl are at a party. Neither one really knows the other, and at some point, a forcible rape occurs when the boy corners a girl in a room alone. Knowing that her story might not be believed, and wanting to document who the perp was, the girl snaps a surreptitious photo with her cell cam as the guy leaves the room.

Could the rape victim be charged as a child pornographer?

When I was 16 there was no such law and society was better off. Now with the long list of draconian laws on the books designed to catch a few dumbasses, people are having their life destroyed...and for what? A few motherfarking headlines? Kids are certainly no better protected.

/I'm not voting Libertarian in '08 but I'm certainly becoming more open minded to the prospect
