Why not both? It's not like those choices have to be mutually exclusive.

It might be stupid, but what's probably actually stupider is if someone actually went out of their way to bust this person.

There are real crimes out there, folks, leave the nudniks smoking buds on the Web cam alone.

Yeah, that too.
(also I cant watch the video so I wasn't really trying to defend the specific dumbtards in it)

Kyosuke: How do we know they are smoking pot?

My legal training (Law & Order) tells me it couldn't be proven, but there's probable cause for a search warrant.

Certainly can't speak for all cases, but it sure as heck looks like enough to qualify for a felony possession charge in numerous states/localities.

And, last I checked, felonies are "real crimes".

"real crime" - You keep using that word. I do not think it means what you think it means.

A felony is a felony. It may be stupid for it to be a felony, but A=A folks.

2007-01-25 01:52:42 PM
But.... is it really a crime when there is not a victim? Who will press the charges, the state? How can they be a victim of someone smoking the weed?

This I have never understood. If someone wants to do heroin til they die, who am I to say they cannot? As long as it does not affect/infringe on someone else's life or well-being (i.e. make them a victim in some form or another) I say do as you like. When some emo kid cuts up his arms with a razor or whatnot, do they go to jail? No! Why? THERE IS NO VICTIM HE DID IT TO HIMSELF!

The same logic applies here.

as much as I hate to cite Wikipedia, it's convenient in this instance... a list of "victimless crimes" (pops)

Can you really be arrested for smoking pot on video?

After watching the video, they ought to arrest them only for being such a bunch of losers.

Great. Prove to the class that he's actually smoking marijuana.

Go.

And BTW, smoking pot is not a felony, and felony possession entails quantity. As in two ounces or more.

Out west here, you'd most likely get a ticket. It's laughable.

One has not only a legal but a moral responsibility to obey just laws,
but conversely, one has a moral responsibility to disobey unjust laws."
-- Rev. Dr. Martin Luther King, Jr.
(1929-1968), US civil rights leader

A just law is a man-made code that squares with the
moral law or the law of God. An unjust law is a code
that is out of harmony with the moral law. To put it in
the terms of Saint Thomas Aquinas, an unjust law is
a human law that is not rooted in eternal and natural law.

Laws can restrain the heartless;
they cannot restrain the heart
Martin Luther King Jr.

One who breaks an unjust law that conscience tells
him is unjust, and who willingly accepts the penalty
of imprisonment in order to arouse the conscience of
the community over it's injustice, is in reality
expressing the highest respect for law.
Martin Luther King Jr., Letter from a
Birmingham Jail, 1963

Well your can film something with a film camera. You can Tape something with a video camera. You can record something with a dvd-camera. While I aggree "videoing" is not a word. What is the proper usage for something that fails to use film, tape or a disk? (i.e. flash memory)

wow i'm honestly amazed at the far reaching effects of this crime. you can literally see society unravelling at the seams as these four asshats sit in an empty room and try and impress people on youtube. i can't believe at the atrocious acts of these evil villians. quick, call in the swat team. bust down the door. they have illegal MP3s and they're supporting terrorists.

had to check the link just to make sure it wasnt someone i would know....lol

great job law enforcement, you solved the case of the potsmoking guys in their own house.... great job...

how many unsolved murders you have?
how many breaking and enterings you have last month? how many were solved?
the list can go on and on, but its just sad that they directed their resources to an easy arrest for something being done thats only harming the morons in the video...

wow looks can be decieving... like you walk into a room that just had a crime committed, you pick up something other thn the phone as the police walk in and you are busted for the previous crime... sure looked like you did something....

and as far as your felony possession, you are unfortunately undereducated on the situation. first it would be a misdemeanor at best, especially since its obvious that whatever they have is for their own personal consumption.
second, at no point did i see anything in the room resembling a couple of ounces... i did see one of the asshats pick up a baggy wrapped around something but i couldnt make it out...
and finally, i hate iowa, the law and order expert, has it pretty much right on... its not the action, its that it gives police the probable cause...

BC
i am just glad you arent anywhere near the law profession...
