If the teacher didn't file charges then the incident is usually swept under the rug. I was threatened several times and asked if I were going to file charges. Once I said yes because I did feel threatened. The other times the students were put on probation by the school.

Schools shouldn't be and aren't where all kids can be helped in all things. Sometimes you need to call the police/social services/a psychiatrist/a doctor/the food bank because schools (and teachers) can't be all things to all students.

Sucks to be the teacher. She's probably dealing with some asshat administrator who refuses to do anything about this kid.

This week, my mom had a student, a kindergartner, go ballistic and violent in her room. The boy knocked things off walls and shelves, threw things off tables, climbed on the tables and chairs and was jumping off. Due to the school boards fear of litigation, she is not permitted to touch the child in any way to intervene. All she can do is try to get the other kids out of the way and pray he doesn't hurt himself. She calls admin, to find that they're in a meeting, and apparently aren't in a hurry to get there. As my mom is getting the other kids out, the kid spys a student and goes after him, wrestling him to the ground. Again, mom cannot touch the kid. She gives him two verbal warnings, then finally has to get the kid off. Then admin shows up and takes the kid away.

THe parents take their time getting there and mom is told the kid is suspended until Monday. Imagine her surprise the next day when the kid is right back in her room. He never was suspended. My mom is stuck with him, and the kid is still exhibiting unstable behavior. The victim kid's mom is about to raise holy hell to the school, but my mom, the teacher, has no power.

fark you, School Board. fark you for not caring about the 14 other students who have a right to an education. fark you for treating my mom like a glorified farking babysitter with no power, and not like the degreed, 15 year tenured professional that she is. fark you for not standing up to asshat farking parents that think their little darling can't do any wrong. My mom told you for two farking weeks that the damn kid needed help, that his personality changed, and you ignored and dismissed her. And if a lawsuit happens, fark you in advance for your long standing tradition of throwing teachers under the bus.

Hello Farkers: it is a common problem for special education teachers. The question is how many assaults don't get reported because of the hassle or dealing with irresponsible parents who put the blame on the teachers and often even allege it was the teacher who assaulted their brat.

Good luck with that lawsuit. Not only would you be fired, but you and the school system would most definately be sued, because this is America, and you would lose your ability to teach any at any school within earshot. Which, thanks to modern communications tech, is a very long distance.

Now, I agree that if anyone assaults you, regardless of any other factor, you should be able to defend yourself, to a point. Not saying that a body builder should just hammer the kid in the jaw, possibly killing him, but the body builder could at least restrain the kid to keep everyone else safe.

I'd love to see the parents of the rest of the students in the class make a big fuss about the teacher NOT doing something about this shiat-stain and kinda put the administration on the spot to FINALLY take a stand.

I think someone else already pointed this out, but the teacher doesn't get to make this decision.

California's Ed. Code says I can suspend a kid from my class for the rest of the day of the offense and all of the following day. That does not mean that the kid is actually suspended from school, they may be put somewhere else on-campus. They're just not in my room.

At most schools I am familiar with, I would need to make arrangements with another teacher to impose this child on their classroom for the day, and provide the child with a stack of work, which will likely be ignored.

The principal may, or may not at his/her discretion, choose to suspend the kid out of school. That's not within my power to say. It is also not in my power to have the child permanently removed from the class.

The reason we do not lay the smackdown on the little farkers is that we (in CA at least) are restricted to only restraining the children, not beating the crap out of them (although there are caveats for self-defense). Since I have not been officially trained in restraint methods, I would not even do that, on the chance that, if I hurt the kid in the process, I would be sued.

When a kid explodes in the classroom, we leave. Move all the other kids out. Let the little farker tear up the class, destroy things (not people), and then charge the family for the cost of replacement later.

Sapience, it will never happen. However, the family of the handcuffed girl here had to move out of the state due to the public derision and scorn she experienced. The whole state, except the NAACP, told her she was a bad mom and to DIAF.

This is why retired LEOs make great teachers, just give the teachers handcuffs, tazers, guns, and proper training and we will have safer schools. I mean, the teachers are dealing with the same juvis that the cops are, so why shouldn't teachers be allowed to protect themselves and other children? Also every school should have riot gear, and every teacher trained with the local law enforcement once every semester to be able to handle said equipment.

Sapience, El Tejon School District did that to one student for sexual assaulting another student, kicked him right out of the District. Then the punks little friends decided to walk out and then jump on cars entering the school grounds and such. Sadly, the couple kids who were doing the worst of it were the few black kids going to that school, and they are screaming racism, despite the kids being little asswipes.

The problem is teachers and administrations barely have any control over public schools anymore, instead of protecting the kids who want (or parents want) to learn and be better educated, it just turns into daycare for kids who are trouble makers and are juvis anyways, screwing it for those who try to better their kids life or their own.

You can blame a lot of parents for farking up the system, the kids, the teachers, the politicians, etc. Bring in retired LEOs and have LE training for teachers.

Some children need to be in alternative education programs. The problem is, as many here have mentioned, teachers are expected to work miracles even though they are given no real power or control. Since everyone is mainstreamed (or "Included"), and there is "no child left behind", the teacher can not remove the student from class. There is no funding for special education aids or help for teachers dealing with emotionally disturbed and mentally ill students in a full classroom. Even if the child is repeatedly violent, many adults now assume the teacher is at fault. Everyone assumes they know more about education and kids than the teacher, and they aren't afraid to say so.

I don't have a college degree. I don't even have a job. But I know a good kid when I see one. Because they're ALL good kids, until dried-out, brain-dead skags like you drag them down and convince them they're no good. You so much as scowl at my niece, or any other kid in this school, and I hear about it, and I'm coming looking for you! Take this quarter, go downtown, and have a rat gnaw that thing off your face! Or allow teachers who are at least over six feet tall and 300 pounds, of muscle. If I was a teacher, no kid would be getting a second chance at me, after the first time, out he goes.

I doubt the teacher had any choice as to kicking the little punk out of class. If the teacher refused to have the kid in his class, the administration would go after the teacher for refusing orders from an asshat who doesn't have to deal with these little monsters every day.

If the teacher continued to refuse to have the student in his class, the kid's parents would sue the teacher for violating their little darling's civil rights. If there's a difference in race, there would be civil right charges filed against the teacher as well.

I'm only 38, but I can remember a time where if a kid hit a teacher, the teacher would be allowed to paddle the little brat and the school administration would have backed him up. The teacher or principal would then call home to tell the kid's mom what happened and the little brat would have found himself over his mom's knee as she used a hairbrush or a switch off a tree in the yard on his ass.

Then the next day when the kid went back to school, he would remember what happened the last time he hit a teacher and behave himself.

Some districts have alternative schools for troubled youth. My brother ended up in one. He walked in thinking he was the toughest SOB on the planet, after a week he realized he wasn't. The teachers took no lip from them at all.

At my daughter's school they had a kid would was hitting other kids (in 1st grade). They tried to boot him out, the mother laid some sympathy crap on the school and they let him stay. Finally he did it again and the school said no more. They tried to pull the race card....then I told 'em that I'd be happy to help the school defend themselves. Eventually they got the hint. We removed out kid from the school after that.

I'm sick of the race card crap. Give it a break, people. If your kid is a screaming frigging moron and gets the boot he's getting the boot for being a screaming frigging moron, not because he's .
