Another excellent example of vigilantism gone horribly wrong.

I can understand the initial feeling the dad felt, but it's not an excuse, not at all.

Deserves to never see his daughter again. If the wife told him this stuff in good faith, then ill give her a pass. If she was elaborating what the little girl said, and basically jumped to conclusions, then she deserves to go to jail too.

Also, I love that the police can proove that a dead guy didn't do something. Yeah, proove that negative. These must be supercops.

Also, I'm just curious how the police concluded the little girl wasn't molested. What sort of criteria do they have to determine that. I guess it has to be all psychological. I mean, theres not really any forensic way to prove that someone layed thier wee-wee across someone elses face is there.

The defense they might try would be 'extreme emotional distress'. The simple example is you come home and find your spouse in bed with someone. The problem is there can't be an intervening event... like going to another room to get a gun.

The father is f'd. He'll end up pleading out to a lesser charge

Kapusta: How can they verify that he DID do it? Because the little girl said so? Face it, little children can say alot of shiat that isn't true. As far as how the police knew, perhaps they had the child examined by a psychologist. Said psychologist might have found inconsistencies in the story or possibly a lack in the usual signs of a victim of molestation. Or the girl might have just come right out and said that the whole thing was made up to begin with.

Point being, until the matter was investigated by competent professionals, judgement should have been held by all parties.

That is not a legal term. If the jury believes that medical/psychiatric diagnosis, he could get voluntary manslaughter, which is less than murder, or possibly nothing if he can show some sort of temporary insanity(more doubtful).

Kapusta, nowhere in any articles I've read did they say the 2-year-old described the man's penis. Her statements sound very vague, and the mother could have either jumped to conclusions or "led the witness", so to speak.

Besides, when I was that age I had a lot of trouble distinguishing my dreams from reality. One time I was convinced that I could fly down the stairs with invisible wings. I'm glad my brother talked me out of throwing myself down the stairs when I wanted to show him I could really fly.

Say it with me now. "PRE-MEDITATION". if the guy had been in the room the same moment that he found out and the dad killed him, then well, EED might be a reasonable defense. THe fact that he got a knife, and snuck in through a window, shows that he had some semblence of control. It's murder 1, IMHO.

Seriously? Just listening to my three year old talk to her grandma on the phone I realize I can never be sure wtf she is talking about. Or, if I ask her who she played with at school, if I make up names and ask if she played with that person, she'll often say "yes." She's not lying; little kids are not just little adults, they think differently.

Look up penal law 125.25(1)(a) and 125.27 (2) in New York State. It's written up very well, and Edington matches every single criteria, so he gets the lightest sentence.
