Back in college, I participated in a concert at the church in DC that Eisenhower attended. The preist told us that the previous priest had whispered in Eisenhower's ear that Under God would be a good addition to the pledge.

I guess he was a lying sack of crap.

Pledge's "Under God" has Michigan connection

(Grand Rapids, June 26, 2002, 11:50 p.m.) Louis C. Rabaut has always been proud of his grandfather. But on Wednesday, his grandfather's legacy became the center of a nationwide controversy.

In California, the federal 9th Circuit Court of Appeals ruled that reciting the Pledge of Allegiance in public school is unconstitutional. The court pointed to two words, "Under God" as objectionable, saying it amounts to a government endorsement of religion.

The ruling only applies to nine western states, but it has set off a firestorm across the country. Louis C. Rabaut understands it all too well. His grandfather was a Michigan Congressman, and author of the bill that made the Pledge of Allegiance include the words "Under God."

"I grew up in a family with a grandfather who was very religious and very patriotic and putting God into the Pledge of Allegiance was a melding of those fundamental beliefs for him," said Rabaut, who was named after his grandfather. The elder Rabaut was a powerful Congressman, and authored the bill President Eisenhower signed into law in 1954. The amended version of the Pledge is has been used for the past 48 years.

For the younger Rabaut, lessons of patriotism were passed on at an early age, so the federal court's decision caught him by surprise. "As a lawyer I think it's a very interesting issue because the Supreme Court opens with a prayer, the Congress of the United States opens with the Pledge of Allegiance."

But, at least one local activist agrees with the court's decision. "At first I was very surprised and I thought it was a very enlightened decision," said Matt Aber-Towns, a local activist and practicing agnostic. He believes a pledge without "Under God" is actually more inclusive. "'Under God' for me and I'm sure for a lot of other people who don't identify as Christians is very alienating," he says.

The Knights of Columbus see it differently. Chapters of the organization began using "Under God" in 1951, a full three years before it became law. "I was disappointed that someone would actually think it's unconstitutional," said Ron White of the local Knights of Columbus. "They tried to weaken a nation today."

However, for the man whose grandfather helped make the phrase "Under God" a part of our lives, the answer isn't so black and white. "If you put it in, it doesn't make people believe," says Rabaut. "If you take it out, it won't make people not believe in God. That's still an issue of the spirit and the soul."

I'm a 3rd degree knight. Only 21 too.

The pledge is NOT a law either. So the part about "congress shall pass no law respecting the establishment of a religion" is not valid here either. Since this is NOT law, it's not unconstitutional.

Besides, it looks pretty obvious that what the founding fathers meant by that was that congress shall not pass a law creating an offical church of america, that you were required to belong to, much like the Church of England was.

Manual -
The case was regarding a Congressional Act in 1954, therefore it's covered by the Constitution. And they were worried about creating an official religion, which "the pledge" does, a monotheistic religion. It not only discriminates against athiests/agnostics, but also polytheists. It should be unconstitutional.

Okay, I get it. So when, like, a Catholic organization suggests a change to an officially sanctioned Pledge, the government obliges; but when American atheists and agnostics finally get to have their objection heard (albeit 50+ years later), it's against tradition and compared vigorously by some to treason.

Got it, thanks, check. You know, the government can say that they don't endorse religions of any kind all they want, but their actions speak for themselves. Farkin' election year, I doubt the senate would've had a collective aneurysm if some of their jobs weren't on the line this November.

"On June 22, 1942, Congress first codified the Pledge as I pledge allegiance to the flag of the United States of Amer-ica and to the Republic for which it stands, one Nation indi-visible, with liberty and justice for all. Pub. L. No. 623, Ch. 435, ? 7, 56 Stat. 380 (1942) (codified at 36 U.S.C. ? 1972). On June 14, 1954, Congress amended Section 1972 to add the words under God after the word Nation. Pub. L. No. 396, Ch. 297, 68 Stat. 249 (1954) ( 1954 Act ). The Pledge is cur-rently codified as I pledge allegiance to the Flag of the United States of America, and to the Republic for which it stands, one nation under God, indivisible, with liberty and jus-tice for all. 4 U.S.C. ? 4 (1998) (Title 36 was revised and recodified by Pub. L. No. 105-225, ? 2(a), 112 Stat. 1494 (1998). Section 172 was abolished, and the Pledge is now found in Title 4.)"

The preceding is from the 9th Circuit's opinion in Newdow vs.U.S Congress. Also,

"[10] In conclusion, we hold that (1) the 1954 Act adding the words under God to the Pledge, and (2) EGUSD s pol-icy and practice of teacher-led recitation of the Pledge, with the added words included, violate the Establishment Clause. The judgment of dismissal is vacated with respect to these two claims, and the cause is remanded for further proceedings consistent with our holding. Plaintiff is to recover costs on this appeal."

That would have been really damn hard to do. I wish people would stop saying that the Declaration of Independence is unconstitutional...it wasn't supposed to be, and it was written TWELVE YEARS EARLIER when the US of A was still a British colony.
