Agreed. I'm sure this would be shot down on that principle, but the problem is, content bans tend to be pretty broad.

I'm going to guess that the lawmakers who passed this probably wrote it overly broadly and it'll ultimately get tossed.

Not that I necessarily agree with either side, but just my opinion.

Seems pretty clear- if the statute effectively prohibits personal letters, than it's probably unconstitutional.

Prisons shouldn't have TVs, weight rooms, porn, or anything not considered a necessity (food, water, a roof I guess). They should be happy they have toilet paper. As far as I'm concerned, they should be in their cages or working all day, nothing else. When you're not working, you better be in your cell. Prison is PUNISHMENT, not a friggin' HoJo. People wouldn't try to go back if it was bad enough in there, people may actually try to reform themselves if prison were as bad as it should be.

Or just to cover other possible circumstances: "...before they fail to raise enough money to avoid a couldn't-be-less-engaged public defender scaring them into a 'no contest' plea" - seen it happen. Given that these people don't have a voice politically, I'm alright with the ACLU attempting to pull an ear to the voiceless.

The ACLU and the prisoners have two different agendas.

For the prisoners, it's all about recreation and entertainment. They really couldn't care less about the success or failure of the lawsuit or the substantive issues it addresses. It's simply something to do, a chance to connect with the outside world, a chance to require someone to pay attention to them and maybe, just maybe, a chance to actually get out for a few hours so as to make a court appearance.

For the ACLU, however, the poorly-worded, over-reaching legislation threatens free speech. If legislators can make such broad prohibitions for one group of people, it potentially opens the door to do so for another.

What the ACLU is all about is limiting the ability of government to intrude upon civil liberties. I generally think that's a good thing. Which is why I'm a card-carrying, dues-paying member of the ACLU.

Prison is supposed to be hard. Kind of like a punishment of sorts. If you go to prison you should have a 5 x 9Ft concrete cell with no radio, tv, porn, smokes, cards, etc.

If you don't want to have your porn and smokes taken away then don't break the law, it is all rather simple.

mmmm...I checked what I wrote, don't recall saying it was the holiday inn, I do, however object that certain things are given to them, that the rest of us have to spend money on. Why can't they live on old readers digests (doctors offices across the US unite, and send them instead of throw them), and what is wrong with crappy reception public television? Do I think it is a great place? Umm, no. Do I think they are given more than they need, Yes!
