If they are digital photos, they are inadmissable in court. (at least in PA it is) A friend of mine is a coroner, and they must take photos with film cameras.

If I'd been accused of all the things these guys were, I'd be talking and talking and talking to anyone who would listen to me until they wouldn't let me talk anymore. I would profess my innocence and say exactly what happened over and over. I don't think I'd lawyer-up like these guys did.

The story is interesting-- however, you are only getting the side of a defense attorney here. The photos, so far as I can tell, haven't been released. And of course, even if she was injured before, and asked to get in, doesn't mean she wasn't assaulted.

Still if it contradicts her story (if she says she was not injured before getting there) it does a lot to undermine the rape charge. And I've always found it curious that the DA chose to say last week, "I'm fairly confident a rape occurred." By and large, lawyers use words for a reason, especially DAs.

Despite all the hyperbole on both sides- and there has been plenty- the facts are slowly, very slowly, sorting themselves out. There are problems with ID of any attackers as well (McFayden, who sent out the crazy "skinning" email, was possibly never identified by the victim as being present, according to some news accounts).

As a lawyer who worked on several sex-crime cases as a prosecutor, I can tell you that adult sexual assault cases almost always have some strange dimension like this. If anything happened that was consensual before the attack, the victim is often loath to admit it after the SOB raped her- which of course damages her credibility.

In general juries do not want to believe that things like this happen. No one will be biased against a rape victim, but if her story somehow doesn't add up, for example if they think she lied about scratches on herself, they will be very hard-pressed to convict anybody.

Compounding factors in this case appear to be an inability to identify some or all the attackers, except by race (all but one were white). I wonder if she's even able to say for sure whether all of them were there.

I find this story fascinating and will be sure to keep following it . . .

Yes, I agree, Duke sucks, but that doesn't mean that those boys (white or otherwise) raped a stripper (black or otherwise). I guess there's no "innocent until proven guilty" any more... it's more like "you're guilty, because there's an investigation."

Nothing good can happen here. If they are found guilty and they didn't rape her then they will suffer as being labled a sexual predator for the rest of her life. If by some chance they are not convicted then Durham will riot. Any time the NAACP gets involved it isn't good. Everything that happens between blacks and whites is not racially motivated. They have already tried the case without having the evidence. One of the quotes from the local NAACP rep went something like "It doesn't matter, someone should be in jail for this"
If they did rape her, I hope they are punished. If they didn't, I hope they send her to jail.

I don't see how the date stamp matters, it can be changed.

I'm not admitted to practice in Pennsylvania, but I sincerely doubt that digital photos are inadmissable.

Your Coroner friend probably means that they are more likely to be attacked, so it's easier to just take film pictures.

The PA rules of evidence seem pretty standard to me, and digital photos seem admissable.

Let's wait till demonstrations are held against you, and cops are weighing whether to book you on charges that could send you to the big house for several decades, to decide whether you want to just talk, talk, and keep talking to the police, telling them the story as many times as they want, asking you detail after detail, jogging your memory so you can throw in new facts you forgot the first time . . . Maybe not the best way to save your ass.

This is standard operating procedure for the white, umm, blue devils. Another lawyer said earlier that an email discussing plans to hire strippers the next night and skin them proves the players' innocence.

Duke lawyers suck.

How does underage drinking, lying about being members of other teams (track and baseball), the email mentioned above, the signgs of sexual assault noticed by a medical examiner, Duke not doing anything about it until a local paper broke the story five days later, and the team playing the next weekend like nothing happened not tell a "real story"? Because anything that makes Duke look bad is obviously a work of fiction? Tell that to Jesica S. and the people affected by surgical utensils "cleaned" in hydrolic fluid.

Duke apologists suck.

Ahhhhh the plot thickens. I find it very interesting that the other stripper was not told of the alleged rape. I wonder how this squares with the previous account that the alleged victim had injuries which were consistent with rape and sodomy. Maybe she was "falling down drunk" and the players took advantage of the situation. Another possibilty is that given her intoxicated state she engaged in consensual sex with the men and later regretted it. In any case, these photos, if accurate, change the dynamics of the case. I hope these boys get the max if the charges are proven; however, I also hope that they are not railroaded for political reasons.

Guilt by investigation is alive and well. Fortunately, CNN took a big leap today and used the word "alleged" in front of "rape" on this morning's broadcast. This, however, suggests that there is some doubt about the allegation, so some people are going to be upset about that, too. But here's the reality: we have a judicial process to sort out what happened in an orderly fashion. Wait for it.

I don't think DNA will be dispositive of this case because you can get DNA material (and you know what I'm talking about) in a variety of consensual ways, particularly if (and I'm saying "if") the complaining witness already had some open wounds before arriving.

Having said that last part... yuck!!! Listen, boys, you really don't want to play with girlies who have open sores. Didn't your parents teach you anything?
