I don't think any of hte Duke players have been arrested yet. Arrest does not mean guilt. OJ was arrested. Robert Blake was arrested. Or do you honestly believe that just because someone is arrested taht they must be guilty?

You're probably right. It gets kind of hard to tell sometimes. My detector may in fact be faulty.

If I'd been accused of all the things these guys were, I'd be talking and talking and talking to anyone who would listen to me until they wouldn't let me talk anymore. I would profess my innocence and say exactly what happened over and over. I don't think I'd lawyer-up like these guys did.

Worst thing you can do, especially if the cops are already conviced that you're guilty. They can twist your words until they mean something completly diffferent then what you meant. In addition if you're inconsistant on any detail that will be used against you. That's what lawyers (good ones anyway) are there for, to keep you from saying stuff that can unintentionaly be used against you. (Assuming of course, you're innocent, if not than go ahead say what's on your mind)

ok, so they tested the DNA of all of the team members (except for the one black guy) and reportedly came up with nothing, and now this comes out. good thing they canceled the season for this, it would be nice if rape cases were treated with the same "inocent until proven guilty" standard that other crimes are.

even if three of them were guilty, how is it fair to punish the entire team of close to 50 kids? and here's what i want to know, if it had been the duck basketball team, would they have cancled the season? no. farking. way. because the school makes millions of dollars of the basketball team every year, and the lacross team probably costs money. it's nice to see how moral a school can be when it doesn't cost them money.

this entire case has irked me.

I agree. Normally a photo is admissible if the person trying to introduce it makes a preliminary showing that it fairly and accurately depicts what it represents.

I don't know NC law, but I have never heard of any state court saying as a blanket rule "digital photos are inadmissible," on grounds that they could be faked, or any other reason. If that were really the law, wouldn't all documents (bills, invoices, contracts) be inadmissible too, since they could be faked in whole or in part?

If a witness takes the stand and says "this picture fairly represents what I saw the night of the party, this is the girl as she appeared that night," the photo is ADMISSIBLE. They don't have to necessarily DISPROVE a forgery in advance just to get it admitted. If the DA inspects the photo in discovery, and raises a challenge on this basis, then they could have a hearing pretrial and the judge would determine if there was sufficient indicia of reliability to let the photo into evidence; the jury could then decide how much weight to give it.

a defense attorney said that the tests were done and no one on the team matched, that's why i said "reportedly", whether it's true or not, it would have been nice to see this treated as "innocent until proven guilty", that's my biggest beef.

At Duke, all athletes are equal, but some athletes are more equal than others. Do you think the University'd've cancelled basketball season? Innocent until proven guilty doesn't apply anymore. It's guilty until the world's forgotten you were proven innocent. And if race is a factor, just forget about ever finding out what happened. Why aren't ALL rapes classified as hate crimes, anyways?

It seems to me that a time stamp on the photos would be irelevant. If they have pictures of this woman standing outside the house with a "major grin on her face," I find it hard to believe it could have been taken after a rape occured. Therefore, the purpose of the photos, to show she had sustained injuries previous to the alleged rape, would still seem viable. Of course I could be wrong, but that's just what I think.

The DA has already said he would press charges even if the DNA evidence came back negative. Doesn't that tell you anything about what's really behind this?

So all of you people whining about how these "rich white kids" have all the power, start looking at the DA, who has complete and utter discretion to prosecute anyone he chooses. He has the unlimited resources of the police department at his disposal, and the microphones of the media pointed in his direction.

Did I mention that he's up for re-election next month in Durham, a majority black city?

I have a pretty sick sense of humor and still found it very disturbing. Even if this guy was joking (which he probably was), he has some serious issues. The only guys that I have met that would joke like this are the ones that I don't leave alone with female friends.

Don't you guys know that if your are drunk you can't be raped? Does the camera have some sort of breathalyzer device that can prove that you are impaired? If you have previous injuries, that means you can't be raped?
A lot of these allegations will be turned back in court.
You know if I was a woman, I would make up rape charges, so I could be pilloried in the press and slandered by knuckle dragging, mouth breathers in here.

I'm not familiar with the laws of North Carolina or Pennsylvania, but mama's_tasty_foods is correct. Digital photos will likely be admissible unless there's some evidence that they're fake.

There are so many gray areas. According to the warrants on the Smoking Gun, they actually give three male names. (Do they just make up names, or are those the actual names of the alleged perpetrators? I don't know how warrants work.) If the names are accurate, why are they having everyone's DNA tested? Shouldn't they charge those three guys? Or in the 30 minutes the alleged rape took place, she never got a good look at any of the three guys so that she could identify them in a line-up or anything? Maybe it's blocked by the trauma, but I don't know. I guess we wait for the DNA results.

Again, in the warrant, it said she went back to her car after initially leaving. But one male came out and convinced her to come back. But a neighbor was interview saying several males were outside, some making racists remarks. Plus, the other stripper said she had no clue what happened, what was going on, or that a rape even occured.

But I should also know from having sat on a 3-week jury trial; there are probably a million facts we'll never hear about or have the opportunity to reflect on. It just seems to me that things aren't adding up. It's frustrating. I'm hoping that this is all just accusation; mostly because as a former lacrosse player, I never want to be associated with people that could do such a horrible thing.

---I didn't hear him say that-- I took his statements to mean the lack of a DNA match wouldn't mean the automatic end of the investigation.

As I've posted before, last week he used the words "I'm fairly confident a rape occurred"--- an odd choice of words unless you think something is a little funny.

The Duke student body, and professional protesters of the world, may be up in arms, but it looks to me like the DA and law enforcement are thus far going about this methodically and professionally, not trying the case in the media.
